  1  4 RELATING TO MOTOR VEHICLE REGISTRATION PERIODS AND PROVIDING
  1  5    AN EFFECTIVE DATE.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 321.24, unnumbered paragraph 9, Code
  1 10 Supplement 1999, is amended to read as follows:
  1 11    A vehicle shall be registered for the registration year.  A
  1 12 vehicle registered for the first time in this state shall be
  1 13 registered for the remaining unexpired months of the
  1 14 registration year and pay a registration fee prorated for the
  1 15 remaining unexpired months of the registration year.  Except
  1 16 for a vehicle registered under chapter 326, a vehicle
  1 17 registered for the first time during the eleventh month of the
  1 18 owner's registration year may be registered for the remaining
  1 19 unexpired months of the registration year as provided in this
  1 20 paragraph or for the remaining unexpired months of the
  1 21 registration year and for the next registration year, upon
  1 22 payment of the applicable registration fees.
  1 23    Sec. 2.  Section 321.40, unnumbered paragraphs 1 and 2,
  1 24 Code 1999, are amended to read as follows:
  1 25    Application for renewal of a vehicle registration shall be
  1 26 made on or after the first day of the month prior to the month
  1 27 of expiration of registration and up to and including the last
  1 28 day of the month following the month of expiration of
  1 29 registration.  The registration shall be renewed upon payment
  1 30 of the appropriate registration fee.  Application for renewal
  1 31 for a vehicle registered under chapter 326 shall be made on or
  1 32 after the first day of the month of expiration of registration
  1 33 and up to and including the last day of the month following
  1 34 the month of expiration of registration.
  1 35    On or before the fifteenth day of the eleventh month of
  2  1 expiration of a vehicle's registration year the county
  2  2 treasurer shall send a statement by mail of fees due to the
  2  3 appropriate owner of record.  The statement shall be mailed to
  2  4 the most current address of record, showing information
  2  5 sufficient to identify the vehicle and a listing of the
  2  6 various fees as appropriate.  Failure to receive a statement
  2  7 shall have no effect upon the accrual of penalty at the
  2  8 appropriate date.
  2  9    Sec. 3.  Section 321.106, Code 1999, is amended to read as
  2 10 follows:
  2 11    321.106  REGISTRATION FOR FRACTIONAL PART OF YEAR.
  2 12    1.  When a vehicle is registered under chapter 326 or a
  2 13 motor truck, truck tractor, or road tractor is registered for
  2 14 a combined gross weight exceeding five tons and there is no
  2 15 delinquency and the registration is made in February or
  2 16 succeeding months through November, the registration fee shall
  2 17 be prorated for the remaining unexpired months of the
  2 18 registration year.  A fee shall not be required for the month
  2 19 of December for a vehicle registered on a calendar year basis
  2 20 on which there is no delinquency.  However, except for a
  2 21 vehicle registered under chapter 326, when such a vehicle is
  2 22 registered in November, the vehicle may be registered for the
  2 23 remaining unexpired months of the registration year or for the
  2 24 remaining unexpired months of the registration year and for
  2 25 the next registration year, upon payment of the applicable
  2 26 registration fees.
  2 27    2.  When a vehicle is registered on a birth month basis and
  2 28 there is no delinquency and the registration is made in the
  2 29 month after the beginning of the registration year or
  2 30 succeeding months the registration fee shall be prorated for
  2 31 the remaining unexpired months of the registration year.  A
  2 32 fee shall not be required for the month of the owner's
  2 33 birthday for a vehicle on which there is no delinquency.
  2 34 However, when a vehicle registered on a birth month basis is
  2 35 registered during the eleventh month of the registration year,
  3  1 the vehicle may be registered for the remaining unexpired
  3  2 months of the registration year or for the remaining unexpired
  3  3 months of the registration year and for the next registration
  3  4 year, upon payment of the applicable registration fees.
  3  5    3.  If a fee computed under this section contains a
  3  6 fractional part of a dollar, the fee shall be computed to the
  3  7 nearest whole dollar.  A fee computed under this section shall
  3  8 not be less than five dollars.  The fee so computed shall be
  3  9 deemed to be the annual registration fee for the remainder of
  3 10 the registration year.
  3 11    4.  A reduction in the registration fee shall not be
  3 12 allowed by the department until the applicant files
  3 13 satisfactory evidence to prove that there is no delinquency in
  3 14 registration.
  3 15    Sec. 4.  EFFECTIVE DATE.  This Act takes effect July 1,
  3 16 2001.
