PAG LIN 1 1 Section 1. Section 42.4, subsection 6, Code 1999, is 1 2 amended to read as follows: 1 3 6. In order to minimize electoral confusion and to 1 4 facilitate communication within state legislative districts, 1 5 each plan drawn under this section shall provide that each 1 6 representative district is wholly included within a single 1 7 senatorial district and that, so far as possible, each 1 8 representative and each senatorial district shall be included 1 9 within a single congressional district.However, the1 10standards established by subsections 1 through 5 shall take1 11precedence where a conflict arises between these standards and1 12the requirement, so far as possible, of including a senatorial1 13or representative district within a single congressional1 14district.However, if the number of senate districts and the 1 15 number of representative districts are evenly divisible by the 1 16 number of congressional districts, each bill embodying a plan 1 17 drawn under this section and submitted under section 42.3 1 18 shall provide that each representative and each senatorial 1 19 district shall be included within a single congressional 1 20 district. 1 21 Sec. 2. Section 42.4, subsection 8, paragraph b, 1 22 subparagraph (1), subparagraph subdivision (b), Code 1999, is 1 23 amended to read as follows: 1 24 (b) The senatorial district in the plan which includes the 1 25 place of residence of the state senator on the date of the 1 26 senator's last election to the senate is the same as the even- 1 27 numbered senatorial district in which the senator resides on 1 28 February 1, 2002, or the senatorial district in the plan which 1 29 includes the place of residence of the state senator on the 1 30 date of the senator's last election to the senate is 1 31 contiguous tosuchthe even-numbered senatorial district in 1 32 which the senator resides on February 1, 2002, and the 1 33 senator's declared residence as of February 1, 2002,wasis 1 34 within the district from which the senator was last elected. 1 35 Areas which meet only at the points of adjoining corners are 2 1 not contiguous. 2 2 Sec. 3. Section 42.4, subsection 8, paragraph b, 2 3 subparagraph (2), Code 1999, is amended to read as follows: 2 4 (2) Each even-numbered senatorial district to which 2 5 subparagraph (1) of this paragraph is not applicable shall 2 6 elect a senator in 2002 for a two-year term commencing in 2 7 January 2003. However, if more than one incumbent state 2 8 senator is residing in an even-numbered senatorial district on 2 9 February 1, 2002, and, on or before February 15, 2002, all but 2 10 one of the incumbent senators resigns from office effective no 2 11 later than January 1, 2003, the remaining incumbent senator 2 12 shall represent the district in the senate for the Eightieth 2 13 General Assembly if the remaining incumbent senator was 2 14 elected to a four-year term which commenced in January 2001 or 2 15 was subsequently elected to fill a vacancy in such a term. A 2 16 copy of the resignation must be filed in the office of the 2 17 secretary of state no later than five p.m. on February 15, 2 18 2002. 2 19 Sec. 4. Section 275.23A, subsection 4, Code 1999, is 2 20 amended to read as follows: 2 21 4. If more than one incumbent director resides in a 2 22 redrawn director district or if the number of incumbent 2 23 directors residing in a redrawn multi-director district 2 24 exceeds the number of directors who are to represent the 2 25 district, the terms of office of the affected directors expire 2 26 at the organizational meeting of the board of directors 2 27 following the next regular school election following the 2 28 adoption of the redrawn districts. 2 29 EXPLANATION 2 30 This bill makes changes relating to the process of 2 31 redistricting in Iowa for congressional, legislative, and 2 32 certain school director districts. 2 33 Code section 42.4, subsection 6, is amended to provide that 2 34 if the number of senate and the number of house districts are 2 35 evenly divisible by the number of congressional districts, the 3 1 legislative districts in plans required to be submitted by the 3 2 legislative service bureau shall be wholly contained within 3 3 congressional district boundaries. 3 4 Code section 42.4, subsection 8, is amended to clarify the 3 5 necessary requirements in determining whether an election in 3 6 November 2002 is required for an even-numbered senate 3 7 district. The amendments to the subsection do not modify 3 8 current law. 3 9 Code section 275.23A, concerning school district elections 3 10 following redistricting, is amended to provide that if the 3 11 number of directors residing in a multi-director district 3 12 following redistricting exceeds the number authorized, each 3 13 affected director's term of office shall end after the 3 14 organizational meeting of the school board following the next 3 15 regular school election after the redrawn districts are 3 16 adopted. 3 17 LSB 6755HV 78 3 18 ec/cf/24
