PAG LIN 1 1 HOUSE FILE 2437 1 2 1 3 AN ACT 1 4 RELATING TO DISCLOSURE BY A POSTSECONDARY EDUCATION INSTITUTION 1 5 OF INFORMATION TO THE PARENT OR GUARDIAN OF A STUDENT. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 22.7, subsection 1, Code Supplement 1 10 1999, is amended to read as follows: 1 11 1. Personal information in records regarding a student, 1 12 prospective student, or former student maintained, created, 1 13 collected or assembled by or for a school corporation or 1 14 educational institution maintaining such records. This 1 15 subsection shall not be construed to prohibit a postsecondary 1 16 education institution from disclosing to a parent or guardian 1 17 information regarding a violation of a federal, state, or 1 18 local law, or institutional rule or policy governing the use 1 19 or possession of alcohol or a controlled substance if the 1 20 child is under the age of twenty-one years and the institution 1 21 determines that the student committed a disciplinary violation 1 22 with respect to the use or possession of alcohol or a 1 23 controlled substance regardless of whether that information is 1 24 contained in the student's education records. 1 25 Sec. 2. STATE BOARD OF REGENTS STUDY COMMUNICATION WITH 1 26 PARENTS AND GUARDIANS OF STUDENTS. The state board of 1 27 regents, in consultation with the community college council, 1 28 the Iowa association of community college trustees, and the 1 29 Iowa association of independent colleges and universities, 1 30 shall conduct a study and recommend methods for opening or 1 31 expanding communication with parents and guardians of students 1 32 under the age of twenty-one years who are enrolled in Iowa's 1 33 postsecondary institutions. The communication studied should 1 34 include information relating to, but not limited to, the 1 35 student's grades or any correlation between student grades and 2 1 violations of a federal, state, or local law, or institutional 2 2 rule or policy governing the use or possession of alcohol or a 2 3 controlled substance except as otherwise provided by the law. 2 4 The results of the study and any recommendations shall be 2 5 submitted to the senate and house standing committees on 2 6 education by December 1, 2000. 2 7 2 8 2 9 2 10 2 11 BRENT SIEGRIST 2 12 Speaker of the House 2 13 2 14 2 15 2 16 MARY E.
