PAG LIN 1 1 HOUSE FILE 2433 1 2 1 3 AN ACT 1 4 RELATING TO COMMUNITY COLLEGE GOVERNANCE. 1 5 1 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 7 1 8 Section 1. Section 256.7, Code Supplement 1999, is amended 1 9 by adding the following new subsection: 1 10 NEW SUBSECTION. 22. Adopt rules directing the community 1 11 colleges to annually and uniformly submit data from the most 1 12 recent fiscal year to the division of community colleges and 1 13 workforce preparation, using criteria determined and 1 14 prescribed by the division via the management information 1 15 system. Financial data submitted to the division by a 1 16 community college shall be broken down by fund. Community 1 17 colleges shall provide data to the division by a deadline set 1 18 by the division. The deadline shall be set for a date that 1 19 permits the division to include the data in a report submitted 1 20 for state board approval and for review by December 15 of each 1 21 year by the house and senate standing education committees and 1 22 the joint subcommittee on education appropriations. 1 23 Sec. 2. Section 256.9, Code Supplement 1999, is amended by 1 24 adding the following new subsection: 1 25 NEW SUBSECTION. 49. Reconcile, with the assistance of the 1 26 community colleges, audited financial statements and the 1 27 financial data submitted to the department. The 1 28 reconciliation shall include an analysis of funding by funding 1 29 source. 1 30 Sec. 3. Section 256.31, Code 1999, is amended by adding 1 31 the following new subsection: 1 32 NEW SUBSECTION. 4. a. The council shall prepare a 1 33 written five-year statewide strategic plan at least once every 1 34 five years for Iowa's community colleges in consultation with 1 35 a working group of stakeholders. The working group shall be 2 1 composed of thirteen members appointed as follows: 2 2 (1) The governor shall appoint one member. 2 3 (2) The Iowa association of community college trustees 2 4 shall appoint one member. 2 5 (3) The Iowa association of community college presidents 2 6 shall appoint one member. 2 7 (4) The administrator of the division of community 2 8 colleges and workforce preparation of the department of 2 9 education or the administrator's designee. 2 10 (5) The director of the department of workforce 2 11 development or the director's designee. 2 12 (6) The director of the department of economic development 2 13 or the director's designee. 2 14 (7) The president of the senate, after consultation with 2 15 the majority leader of the senate, shall appoint one 2 16 legislative member. 2 17 (8) The minority leader of the senate shall appoint one 2 18 legislative member. 2 19 (9) The speaker of the house shall appoint one legislative 2 20 member. 2 21 (10) The minority leader of the house of representatives 2 22 shall appoint one legislative member. 2 23 (11) The Iowa association of school boards shall appoint 2 24 one member. 2 25 (12) The Iowa state education association shall appoint 2 26 one member. 2 27 (13) The Iowa association of business and industry shall 2 28 appoint one member. 2 29 b. A legislative member is eligible for per diem and 2 30 expenses as provided in section 2.10. Appointments to the 2 31 task force are subject to the requirements of sections 69.16 2 32 and 69.16A. 2 33 c. The plan shall be submitted to the state board of 2 34 education for approval and adoption. 2 35 Sec. 4. COMMUNITY COLLEGE DATA COMPARISON AND PROGRESS 3 1 REPORT. The director of the department of education shall 3 2 provide the following: 3 3 1. A comparison of the data elements collected by the 3 4 basic educational data elements survey for K-12 schools to the 3 5 data being collected by the management information system for 3 6 community colleges to the chairpersons and ranking members of 3 7 the joint subcommittee on education appropriations by January 3 8 15, 2001. 3 9 2. A report on the progress toward implementation of the 3 10 management information system to the legislative fiscal bureau 3 11 and department of management by June 30, 2000. 3 12 3. An update on the progress toward implementation of the 3 13 management information system to the house and senate standing 3 14 education committees and the joint subcommittee on education 3 15 appropriations by January 15, 2001. 3 16 The report and the update required pursuant to subsections 3 17 2 and 3 shall include, but shall not be limited to, 3 18 information on the total amounts appropriated and expended for 3 19 purposes of the management information system, the amount 3 20 needed to complete the system, the hardware and software 3 21 needed, and a description of the information the complete 3 22 system is capable of providing. 3 23 4. A plan to improve sharing of data on student academic 3 24 performance and career planning between school districts and 3 25 community colleges. The plan shall be developed utilizing 3 26 community college personnel and the bureau of community 3 27 colleges. 3 28 5. A report on strategic planning transmitted to the 3 29 senate and house standing committees on education and the 3 30 joint appropriations subcommittee on education by January 15, 3 31 2001. 3 32 Sec. 5. INITIAL STATEWIDE STRATEGIC PLAN. Notwithstanding 3 33 section 256.31, subsection 4, the state board of education 3 34 shall submit a preliminary report regarding the initial 3 35 statewide strategic plan by December 1, 2000.
