  1  4 RELATING TO THE CERTIFICATION OF PERSONS AS CONFINEMENT SITE
  1  5    MANURE APPLICATORS, PROVIDING FOR FEES, AND MAKING PENALTIES
  1  6    APPLICABLE.  
  1  7 
  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 455B.203A, subsection 1, Code
  1 11 Supplement 1999, is amended by adding the following new
  1 12 paragraph:
  1 13    NEW PARAGRAPH.  d.  "Family member" means a person related
  1 14 to another person as a spouse, parent, grandparent, child,
  1 15 grandchild, or sibling.
  1 16    Sec. 2.  Section 455B.203A, subsection 3, paragraph b, Code
  1 17 Supplement 1999, is amended to read as follows:
  1 18    b.  A person required to be certified as a confinement site
  1 19 manure applicator must be certified by the department every
  1 20 three years.  The However, if the person is exempt from paying
  1 21 the certification fee because a family member has paid a
  1 22 certification fee as provided in this section, the person's
  1 23 certification shall expire on the same date that the paid
  1 24 family member's certification expires.  A person shall be
  1 25 certified after completing an educational program which shall
  1 26 consist of an examination required to be passed by the person
  1 27 or two hours of continuing instructional courses which the
  1 28 person must attend each year in lieu of passing the
  1 29 examination.
  1 30    Sec. 3.  Section 455B.203A, subsection 5, paragraph b,
  1 31 subparagraph (1), Code Supplement 1999, is amended to read as
  1 32 follows:
  1 33    (1)  The person is a part-time employee or family member of
  1 34 a confinement site manure applicator.
  1 35    Sec. 4.  Section 455B.203A, subsection 6, paragraph a, Code
  2  1 Supplement 1999, is amended to read as follows:
  2  2    a.  The department may charge a fee for certifying persons
  2  3 a person under this section.  The fee for certification shall
  2  4 be based on the costs of administering and enforcing this
  2  5 section and paying the expenses of the department relating to
  2  6 certification.  A person who is certified as a confinement
  2  7 site manure applicator as provided in this section is exempt
  2  8 from paying the certification fee, if all of the following
  2  9 apply:
  2 10    (1)  The person is certified within one year from the date
  2 11 that a family member has been certified as a confinement site
  2 12 manure applicator.
  2 13    (2)  The family member has paid the fee for that family
  2 14 member's own certification.
