  1  1    Section 1.  Section 341A.7, unnumbered paragraph 1, Code
  1  2 1999, is amended to read as follows:
  1  3    The classified civil service positions covered by this
  1  4 chapter include persons actually serving as deputy sheriffs
  1  5 who are salaried pursuant to section 331.904, subsection 2,
  1  6 but do not include a chief deputy sheriff, two second deputy
  1  7 sheriffs in counties with a population of more than one
  1  8 hundred thousand, and four second deputy sheriffs in counties
  1  9 with a population of more than two hundred thousand.  However,
  1 10 a chief deputy sheriff or second deputy sheriff who becomes a
  1 11 candidate for a partisan elective office for remuneration is
  1 12 subject to section 341A.18.  A deputy sheriff serving with
  1 13 permanent rank under this chapter may be designated chief
  1 14 deputy sheriff or second deputy sheriff and retain that rank
  1 15 during the period of service as chief deputy sheriff or second
  1 16 deputy sheriff and shall, upon termination of the duties as
  1 17 chief deputy sheriff or second deputy sheriff, revert to the
  1 18 permanent rank.
  1 19    Sec. 2.  Section 341A.18, unnumbered paragraph 8, Code
  1 20 1999, is amended by striking the unnumbered paragraph.
  1 21    Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of
  1 22 immediate importance, takes effect upon enactment.  
  1 23                           EXPLANATION
  1 24    This bill strikes a provision from the Code that requires
  1 25 county civil service employees, including deputies in the
  1 26 sheriff's office, to take a leave of absence when such
  1 27 employees are candidates for paid elective office in a primary
  1 28 or general election.  If the bill is enacted, Code section
  1 29 55.4 will apply to county civil service employees.  That
  1 30 section allows a public employee who is a candidate for
  1 31 elective office to request a leave of absence for a period
  1 32 commencing 30 days before a contested election and ending
  1 33 after the day following the election.  The leave of absence
  1 34 shall be automatically granted upon request.
  1 35    The bill takes effect upon enactment.
