  1  1    Section 1.  Section 236.3, subsections 1 and 2, Code 1999,
  1  2 are amended to read as follows:
  1  3    1.  Name of the plaintiff and the name and address of the
  1  4 plaintiff's attorney, if any.  If the plaintiff is proceeding
  1  5 pro se, the petition shall state a mailing address for the
  1  6 plaintiff.  A mailing address may be provided by the plaintiff
  1  7 pursuant to section 236.10.
  1  8    2.  Name and address of the parent or guardian filing the
  1  9 petition, if the petition is being filed on behalf of an
  1 10 unemancipated minor.  For the purposes of this chapter,
  1 11 "plaintiff" includes a person filing an action on behalf of an
  1 12 unemancipated minor.  A mailing address may be provided by the
  1 13 plaintiff pursuant to section 236.10.
  1 14    Sec. 2.  Section 236.10, Code 1999, is amended to read as
  1 15 follows:
  1 16    236.10  CONFIDENTIALITY OF RECORDS.
  1 17    1.  A person seeking relief from domestic abuse under this
  1 18 chapter may use the address of a shelter or other agency as a
  1 19 mailing address for purposes of filing a petition under this
  1 20 chapter, as well as for the purpose of obtaining any utility
  1 21 or other service.
  1 22    2.  The file in a domestic abuse case shall be sealed by
  1 23 the clerk of court when it is complete and after the time for
  1 24 appeal has expired.  However, the clerk shall open the file
  1 25 upon application to and order of the court for good cause
  1 26 shown or upon request of the child support recovery unit.
  1 27 Support payment records, whether maintained by the clerk of
  1 28 the district court or the department of human services, are
  1 29 public records and may be released upon request.  However, a
  1 30 payment record shall not include address or location
  1 31 information.  
  1 32                           EXPLANATION
  1 33    This bill amends certain sections of Code chapter 236
  1 34 relating to relief from domestic abuse.  The bill provides
  1 35 that the plaintiff may use the address of a shelter or other
  2  1 agency as a mailing address for purposes of filing a petition
  2  2 under the chapter, as well as for obtaining utility or other
  2  3 services.
