1 3 RELATING TO AUTHORIZATION TO PROVIDE EMERGENCY AND
1 4 NONEMERGENCY MEDICAL CARE SERVICES.

1 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 8 Section 1. Section 147A.8, subsection 2, Code Supplement
1 9 1999, is amended to read as follows:
1 10 2. Function in any hospital or any other entity in which
1 11 health care is ordinarily provided only when under the direct
1 12 supervision, as defined by rules adopted pursuant to chapter
1 13 17A, of a physician, when:
1 14 a. Enrolled as a student or participating as a preceptor
1 15 in a training program approved by the department; or
1 16 b. Fulfilling continuing education requirements as defined
1 17 by rule; or
1 18 c. Employed by or assigned to a hospital or other entity
1 19 in which health care is ordinarily provided only when under
1 20 the direct supervision of a physician, as a member of an
1 21 authorized ambulance, rescue, or first response service, or in
1 22 an individual capacity, by rendering lifesaving services in
1 23 the facility in which employed or assigned pursuant to the
1 24 emergency medical care provider's certification and under the
1 25 direct supervision of a physician, physician assistant, or
1 26 registered nurse. An emergency medical care provider shall
1 27 not routinely function without the direct supervision of a
1 28 physician, physician assistant, or registered nurse. However,
1 29 when the physician, physician assistant, or registered nurse
1 30 cannot directly assume emergency care of the patient, the
1 31 emergency medical care provider may perform without direct
1 32 supervision emergency medical care procedures for which that
1 33 individual is certified if the life of the patient is in
1 34 immediate danger and such care is required to preserve the
1 35 patient's life; or
2 1 d. Employed by or assigned to a hospital or other entity
2 2 in which health care is ordinarily provided only when under
2 3 the direct supervision of a physician, as a member of an
2 4 authorized ambulance, rescue, or first response service, or in
2 5 an individual capacity, to perform nonlifesaving procedures
2 6 for which those individuals have been trained and are
2 7 designated in a written job description. Such procedures may
2 8 be performed after the patient is observed by and when the
2 9 emergency medical care provider is under the supervision of
2 10 the physician, physician assistant, or registered nurse,
2 11 including when the registered nurse is not acting in the
2 12 capacity of a physician designee, and where the procedure may
2 13 be immediately abandoned without risk to the patient.
