  1  1    Section 1.  Section 455B.204A, unnumbered paragraph 1, Code
  1  2 1999, is amended to read as follows:
  1  3    The department shall adopt rules relating to the disposal
  1  4 application of manure in close proximity to a designated area.
  1  5 A Except as provided in this section, a person shall not
  1  6 dispose of apply manure on cropland within two hundred feet
  1  7 from of a designated area, unless.  Manure may be applied
  1  8 within two hundred feet of a designated area other than a
  1  9 drinking water well if one of the following applies:  
  1 10                           EXPLANATION
  1 11    This bill amends Code section 455B.204A which provides
  1 12 separation distance requirements for the application of manure
  1 13 within a designated area which includes a known sinkhole,
  1 14 cistern, abandoned well, unplugged agricultural drainage well,
  1 15 agricultural drainage well surface inlet, drinking water well,
  1 16 lake, farm pond, or privately owned lake.  An exception exists
  1 17 if manure is applied by injection or incorporation within 24
  1 18 hours following the application or an area of permanent
  1 19 vegetation cover exists for 50 feet surrounding the designated
  1 20 area.  This bill provides that the exceptions do not apply to
  1 21 manure applied within 200 feet of a drinking water well.  A
  1 22 person who violates the part of the Code chapter regulating
  1 23 water quality is, according to Code section 455B.191, subject
  1 24 to a civil penalty of not more than $5,000.  A person
  1 25 classified as a habitual violator under that section is
  1 26 subject to a civil penalty of $25,000.
