  1  1    Section 1.  NEW SECTION.  483A.28  HUNTING GUIDE LICENSES
  1  2 – PENALTY.
  1  3    1.  A person shall not engage in or be employed for any
  1  4 compensation or reward for hunting guide activities in this
  1  5 state unless the person has obtained a hunting guide license
  1  6 from the department.  The department shall define, by rule,
  1  7 the activities that constitute hunting guide activities for
  1  8 purposes of this section.  The rules shall require an
  1  9 applicant to identify the location and number of acres to be
  1 10 hunted and to submit a management plan which is subject to
  1 11 approval by the department.
  1 12    2.  Upon application and payment of the hunting guide
  1 13 license fee as provided in subsection 3 and an approved
  1 14 management plan, the department shall issue a guide license to
  1 15 an applicant who agrees to faithfully perform the duties and
  1 16 responsibilities of a licensed hunting guide and who agrees to
  1 17 observe and comply with the requirements of chapters 481A and
  1 18 484A, this chapter, and the rules of the department relating
  1 19 to hunting guides and the hunting of game in this state.  A
  1 20 hunting guide is responsible for informing hunting clients of
  1 21 all applicable hunting laws and rules.  A hunting guide
  1 22 license shall not be issued to a person who is under eighteen
  1 23 years of age.
  1 24    3.  The department shall establish, by rule, the annual fee
  1 25 for a hunting guide license issued pursuant to this chapter.
  1 26 In determining an annual fee, the department shall consider
  1 27 the costs of issuing the license and administering and
  1 28 enforcing the provisions of this section.
  1 29    4.  A violation of this section is a simple misdemeanor and
  1 30 is punishable as provided in section 483A.42.  
  1 31                           EXPLANATION
  1 32    This bill requires the licensing of persons who provide
  1 33 hunting guide services.  The department of natural resources
  1 34 is directed to issue hunting guide licenses upon application
  1 35 and payment of an annual fee determined by rule of the
  2  1 commission to persons who agree to faithfully perform the
  2  2 duties and responsibilities of a licensed hunting guide and
  2  3 agree to observe and comply with the requirements of the
  2  4 hunting laws and rules of the department.  An applicant shall
  2  5 identify the location and number of acres of the land to be
  2  6 hunted and submit a game management plan which is subject to
  2  7 approval by the department.  A hunting guide must be at least
  2  8 18 years of age to be licensed.
  2  9    Violators are guilty of a simple misdemeanor and subject to
  2 10 a minimum fine of $10 for each offense.  The maximum fine for
  2 11 a simple misdemeanor is $500 and the court may order not more
  2 12 than 30 days' imprisonment in lieu of or in addition to a
  2 13 fine.
