PAG LIN 1 1 Section 1. Section 257.1, subsection 2, unnumbered 1 2 paragraph 2, Code Supplement 1999, is amended to read as 1 3 follows: 1 4 For the budget year commencing July 1, 1999, and for each 1 5 succeeding budget year the regular program foundation base per 1 6 pupil is eighty-seven and five-tenths percent of the regular 1 7 program state cost per pupil. For the budget year beginning 1 8 July 1, 2000, this amount shall be increased by an additional 1 9 amount determined pursuant to section 257.10, subsection 2, 1 10 paragraph "c". For the budget year commencing July 1, 1991, 1 11 and for each succeeding budget year the special education 1 12 support services foundation base is seventy-nine percent of 1 13 the special education support services state cost per pupil. 1 14 The combined foundation base is the sum of the regular program 1 15 foundation base and the special education support services 1 16 foundation base. 1 17 Sec. 2. Section 257.10, subsection 2, Code Supplement 1 18 1999, is amended by adding the following new paragraph: 1 19 NEW PARAGRAPH. c. For the budget year beginning July 1, 1 20 2000, the regular program district cost per pupil determined 1 21 pursuant to paragraph "a" for each school district shall be 1 22 increased by an amount equal to ten million dollars times the 1 23 budget enrollment for that school district divided by the 1 24 combined budget enrollment for all school districts in the 1 25 state. Notwithstanding paragraph "b", the regular program 1 26 district cost per pupil shall not be subject to a reduction if 1 27 the regular program district cost per pupil would not have 1 28 exceeded one hundred five percent of the regular program state 1 29 cost per pupil but for the increase received pursuant to this 1 30 paragraph. For purposes of determining the amount of a budget 1 31 adjustment as defined in section 257.14, the increase received 1 32 pursuant to this paragraph shall be subtracted from the school 1 33 district's regular program district cost per pupil for the 1 34 budget year beginning July 1, 2000, prior to determining the 1 35 amount of the adjustment. 2 1 Sec. 3. Section 257.11, subsection 2, unnumbered paragraph 2 2 1, Code 1999, is amended to read as follows: 2 3 If the school budget review committee certifies to the 2 4 department of management that the shared classes or teachers 2 5 would otherwise not be implemented without the assignment of 2 6 additional weighting, pupils attending classes in another 2 7 school district or a community college, attending classes 2 8 taught by a teacher who is employed jointly under section 2 9 280.15, or attending classes taught by a teacher who is 2 10 employed by another school district, are assigned a weighting 2 11 of one plus an additional portion equal to one times the 2 12 percent of the pupil's school day during which the pupil 2 13 attends classes in another district or community college, 2 14 attends classes taught by a teacher who is jointly employed 2 15 under section 280.15, or attends classes taught by a teacher 2 16 who is employed by another school district. A pupil attending 2 17 a class in which students from one or more other school 2 18 districts are enrolled and the class is taught via the Iowa 2 19 communications network is not deemed to be attending a class 2 20 in another school district for the purposes of this subsection 2 21 and the school district is not eligible for additional 2 22 weighting for that class under this subsection. A pupil 2 23 enrolled in an alternative high school program in another 2 24 school district shall not be eligible for additional weighting 2 25 under this subsection. 2 26 Sec. 4. NEW SECTION. 257.50 AT-RISK PROGRAMS. 2 27 The increase in the regular program district cost per pupil 2 28 for the budget year beginning July 1, 2000, pursuant to 2 29 section 257.10, subsection 2, paragraph "c", shall be utilized 2 30 by school districts to develop or maintain at-risk pupils 2 31 programs or alternative programs, including alternative high 2 32 school programs, for pupils in grades nine through twelve, and 2 33 shall be in addition to and shall not supplant moneys 2 34 appropriated in section 279.51 and moneys otherwise 2 35 appropriated by law for at-risk pupils programs and 3 1 alternative programs. 3 2 Sec. 5. EFFECTIVE DATE. This Act, being deemed of 3 3 immediate importance, takes effect upon enactment. 3 4 EXPLANATION 3 5 This bill provides for additional state aid to school 3 6 districts for at-risk programs. The bill provides that the 3 7 regular program foundation base per pupil, and the district 3 8 cost per pupil, shall be increased by an amount equal to $10 3 9 million divided by the combined budget enrollment for each 3 10 school district in the state, for the school budget year 3 11 beginning July 1, 2000. The bill provides that the increase 3 12 in district cost per pupil shall be utilized by school 3 13 districts to develop or maintain at-risk pupils programs or 3 14 alternative programs, including alternative high school 3 15 programs, for pupils in grades nine through 12. 3 16 The bill also provides that the increase in district cost 3 17 per pupil shall not be counted for purposes of determining 3 18 whether or not the regular program district cost of a school 3 19 district exceeds 105 percent of the regular program state cost 3 20 per pupil, which would otherwise result in a reduction in 3 21 district cost per pupil pursuant to Code section 257.10, 3 22 subsection 2, paragraph "b". The bill additionally provides 3 23 that for purposes of determining the amount of a budget 3 24 adjustment pursuant to Code section 257.14, the increase shall 3 25 be subtracted from the school district's regular program 3 26 district cost per pupil for the budget year beginning July 1, 3 27 2000, prior to determining the amount of the adjustment. The 3 28 bill provides that school districts shall no longer be 3 29 eligible for supplementary weighting currently received for 3 30 pupils enrolled in shared alternative high school programs 3 31 between school districts pursuant to Code section 257.11, 3 32 subsection 2. 3 33 The bill takes effect upon enactment. 3 34 LSB 5578HH 78 3 35 rn/as/5
