PAG LIN 1 1 Section 1. Section 357A.12, unnumbered paragraph 2, Code 1 2 1999, is amended to read as follows: 1 3 The procedures for contract letting specified in sections 1 4 384.95 through 384.102 and as specified in section 384.103, 1 5 subsection 2, shall apply to construction carried out pursuant 1 6 to this chapter, except that the contract letting procedures 1 7 shall apply when the estimated total cost of the improvement 1 8 exceeds twenty-five thousand dollars. References in those 1 9 sections to a city shall be applicable to a rural water 1 10 district operating under this chapter, and references to a 1 11 city council shall be applicable to the board of directors of 1 12 a rural water district. 1 13 Sec. 2. Section 384.96, Code 1999, is amended to read as 1 14 follows: 1 15 384.96 SEALED BIDS. 1 16 When the estimated total cost to a city of a public 1 17 improvement exceeds the sum oftwenty-fivefifty thousand 1 18 dollars, the governing body shall advertise for sealed bids 1 19 for the proposed improvement by publishing a notice to bidders 1 20 as provided in section 362.3, except that the notice to 1 21 bidders may be published more than twenty days but not more 1 22 than forty-five days before the date for filing bids. 1 23 Sec. 3. Section 384.102, Code 1999, is amended to read as 1 24 follows: 1 25 384.102 WHEN HEARING NECESSARY. 1 26WhenIf the estimated total cost of a public improvement 1 27 exceeds the sumof twenty-five thousand dollarsspecified in 1 28 section 384.96, the governing body shall not enter into a 1 29 contract for the improvement until it has held a public 1 30 hearing on the proposed plans, specifications, and form of 1 31 contract, and estimated cost for the improvement. Notice of 1 32 the hearing must be published as provided in section 362.3. 1 33 At the hearing any interested person may appear and file 1 34 objections to the proposed plans, specifications, contract, or 1 35 estimated cost of the improvement. After hearing objections, 2 1 the governing body shall by resolution enter its decision on 2 2 the plans, specifications, contract, and estimated cost. 2 3 EXPLANATION 2 4 This bill increases the estimated total cost of a city 2 5 improvement which requires contract letting procedures from 2 6 $25,000 to $50,000. 2 7 The contracting procedures for a rural water district 2 8 improvement which, by statutory reference, are the same as for 2 9 a city are amended so that the estimated cost of an 2 10 improvement which requires the public bidding remains at 2 11 $25,000. 2 12 LSB 5639YH 78 2 13 tj/gg/8
