  1  1    Section 1.  NEW SECTION.  364.25  POLICE PROTECTION –
  1  2 CITIES UNDER FIVE HUNDRED POPULATION.
  1  3    A city having a population of less than five hundred may
  1  4 provide or discontinue police protection within its
  1  5 jurisdiction or may provide for police protection by
  1  6 intergovernmental agreement for an annual amount not to exceed
  1  7 twenty dollars per capita.
  1  8    Sec. 2.  Section 372.4, unnumbered paragraph 3, Code 1999,
  1  9 is amended to read as follows:
  1 10    The mayor shall appoint a council member as mayor pro tem,
  1 11 and shall appoint the marshal or chief of police except where
  1 12 an intergovernmental agreement makes other provisions for
  1 13 police protection or as otherwise provided in section 400.13.
  1 14 However, if a city having a population of less than five
  1 15 hundred discontinues police protection, the city may provide
  1 16 for police protection by intergovernmental agreement as
  1 17 provided in section 364.25.  Other officers must be selected
  1 18 as directed by the council.  The mayor is not a member of the
  1 19 council and may not vote as a member of the council.  
  1 20                           EXPLANATION
  1 21    This bill provides that a city having a population of less
  1 22 than 500 may discontinue police protection or may provide for
  1 23 police protection by intergovernmental agreement for an annual
  1 24 amount not to exceed $20 per capita.
