  1  1    Section 1.  Section 692A.3, Code Supplement 1999, is
  1  2 amended to read as follows:
  1  3    692A.3  REGISTRATION PROCESS.
  1  4    1.  A person required to register under this chapter shall
  1  5 register with the sheriff of the county of the person's
  1  6 residence within ten five days of establishment of residence
  1  7 in this state or within ten five days of any conviction for
  1  8 which the person is not incarcerated, a release from custody,
  1  9 or placement on probation, parole, or work release.  A sheriff
  1 10 shall accept the registration of a nonresident of the county
  1 11 if the person required to register is a full-time or part-time
  1 12 student or is employed on a full-time or part-time basis in
  1 13 the county.
  1 14    2.  A person required to register under this chapter shall,
  1 15 within ten five days of changing residence within a county in
  1 16 this state or within ten five days of a change in the person's
  1 17 name as a result of marriage, dissolution of marriage, or a
  1 18 legal name change, notify the sheriff of the county in which
  1 19 the person is registered of the change of address, name, and
  1 20 any changes in the person's telephone number in writing on a
  1 21 form provided by the sheriff.  The sheriff shall send a copy
  1 22 of the change of information to the department within three
  1 23 working days of receipt of notice of the change.  The sex
  1 24 offender registry shall maintain and make available
  1 25 information from the registry cross-referenced by name at the
  1 26 time of conviction and by name subsequent to any change.
  1 27    3.  A person required to register under this chapter shall
  1 28 register with the sheriff of a county in which residence has
  1 29 been newly established and notify the sheriff of the county in
  1 30 which the person was registered, within ten five days of
  1 31 changing residence to a location outside the county in which
  1 32 the person was registered.  Registration shall be in writing
  1 33 on a form provided by the sheriff and shall include the
  1 34 person's change of address and any changes to the person's
  1 35 telephone number or name.  The sheriff shall send a copy of
  2  1 the change of information to the department within three
  2  2 working days of receipt of notice of the change.
  2  3    4.  A person required to register under this chapter shall
  2  4 notify the sheriff of the county in which the person is
  2  5 registered, within ten five days of changing residence to a
  2  6 location outside this state, of the new residence address and
  2  7 any changes in telephone number or name.  The sheriff shall
  2  8 send a copy of the change to the department within three
  2  9 working days of receipt of notice of the change.  The person
  2 10 must register with the registering agency of the other state
  2 11 within ten five days of changing residency, if persons are
  2 12 required to register under the laws of the other state.  The
  2 13 department shall notify the registering agency in the other
  2 14 state of the registrant's new address, telephone number, or
  2 15 name.
  2 16    5.  The collection of information by a court or releasing
  2 17 agency under section 692A.5 shall serve as the person's
  2 18 initial registration for purposes of this section.  The court
  2 19 or releasing agency shall forward a copy of the registration
  2 20 to the department within three working days of completion of
  2 21 registration.
  2 22    Sec. 2.  Section 692A.5, subsection 1, paragraphs c and d,
  2 23 Code Supplement 1999, are amended to read as follows:
  2 24    c.  Inform the person that, within ten five days of
  2 25 changing residence, registration with the sheriff in the
  2 26 county in which residence is established is required, if the
  2 27 residence is within the state.
  2 28    d.  Inform the person that if the person moves the person's
  2 29 residence to another state, the person must give the person's
  2 30 new address to the sheriff's department in the county of the
  2 31 person's old residence within ten five days of changing
  2 32 addresses, and that, if the other state has a registration
  2 33 requirement, the person is also required to register in the
  2 34 new state of residence, not later than ten five days after
  2 35 establishing residence in the other state and to verify the
  3  1 address at least annually.  
  3  2                           EXPLANATION
  3  3    This bill relates to the registration and notification
  3  4 process of the sex offender registry.
  3  5    The bill reduces the length of time for a sex offender to
  3  6 register with a county sheriff or to notify the sheriff of an
  3  7 address or name change from 10 days to five days.
  3  8    An offender who intentionally fails to register commits an
  3  9 aggravated misdemeanor for a first offense and a class "D"
  3 10 felony for a second or subsequent offense.  If an offender
  3 11 intentionally fails to register and subsequently commits an
  3 12 offense against a minor or certain sexual criminal offenses,
  3 13 the offender commits a class "C" felony.
  3 14    An aggravated misdemeanor is punishable by confinement for
  3 15 no more than two years and a fine of at least $500 but not
  3 16 more than $5,000.  A class "D" felony is punishable by
  3 17 confinement for no more than five years and a fine of at least
  3 18 $750 but not more than $7,500.  A class "C" felony is
  3 19 punishable by confinement for no more than 10 years and a fine
  3 20 of at least $1,000 but not more than $10,000
