PAG LIN 1 1 Section 1. Section 455C.1, subsection 1, Code 1999, is 1 2 amended to read as follows: 1 3 1. "Beverage" means wine as defined in section 123.3, 1 4 subsection 37, alcoholic liquor as defined in section 123.3, 1 5 subsection 5, beer as defined in section 123.3, subsection 7, 1 6 mineral water, soda water and similar carbonated soft drinks, 1 7 wine cooler or drink, tea, potable water, fruit or vegetable 1 8 juice, fruit or vegetable drinks, and other noncarbonated 1 9 drinks excluding milk in liquid form and intended for human 1 10 consumption. 1 11 Sec. 2. Section 455C.2, Code 1999, is amended to read as 1 12 follows: 1 13 455C.2 REFUND VALUES. 1 14 1. A refund value of not less thanfiveten cents shall be 1 15 paid by the consumer on each beverage container sold in this 1 16 state by a dealer for consumption off the premises. Upon 1 17 return of the empty beverage container upon which a refund 1 18 value has been paid to the dealer or person operating a 1 19 redemption center and acceptance of the empty beverage 1 20 container by the dealer or person operating a redemption 1 21 center, the dealer or person operating a redemption center 1 22 shall return the amount of the refund value to the consumer. 1 23 2. In addition to the refund value provided in subsection 1 24 1 of this section, a dealer, or person operating a redemption 1 25 center who redeems empty beverage containers or a dealer agent 1 26 shall be reimbursed by the distributor required to accept the 1 27 empty beverage containers an amount which isone centtwo 1 28 cents per container. A dealer, dealer agent, or person 1 29 operating a redemption center may compact empty metal beverage 1 30 containers with the approval of the distributor required to 1 31 accept the containers. 1 32 Sec. 3. Section 455C.5, subsection 3, Code 1999, is 1 33 amended to read as follows: 1 34 3. The provisions of subsections 1 and 2 of this section 1 35 do not apply to a refillable glass beverage container which 2 1 has a brand name permanently marked on it and which has a 2 2 refund value of not less thanfiveten cents, to any other 2 3 refillable beverage container which has a refund value of not 2 4 less thanfiveten cents and which is exempted by the director 2 5 under rules adopted by the commission, or to a beverage 2 6 container sold aboard a commercial airliner or passenger train 2 7 for consumption on the premises. 2 8 EXPLANATION 2 9 This bill expands the list of beverage containers which are 2 10 included under the beverage container control laws in Code 2 11 chapter 455C. The new beverage containers include wine 2 12 coolers or drinks, tea, potable water, fruit or vegetable 2 13 juices, fruit or vegetable drinks, and other noncarbonated 2 14 drinks excluding milk. 2 15 The bill increases the refund value of beverage containers 2 16 from not less than $.05 per container to not less than $.10 2 17 per container. The bill also increases the reimbursement 2 18 amount received by a dealer or person operating a redemption 2 19 center who redeems empty beverage containers from $.01 per 2 20 container to $.02 per container. 2 21 LSB 6270HH 78 2 22 tm/cls/14
