  1  4 RELATING TO HEALTH CERTIFICATE REQUIREMENTS FOR BREEDING BULLS
  1  5    AND MAKING PENALTIES APPLICABLE.  
  1  6 
  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 163.40, Code 1999, is amended by adding
  1 10 the following new subsection:
  1 11    NEW SUBSECTION.  3.  "Licensee" means a person required to
  1 12 obtain a license pursuant to section 163.41.
  1 13    Sec. 2.  Section 163.43, Code 1999, is amended to read as
  1 14 follows:
  1 15    163.43  HEALTH CERTIFICATE REQUIRED.
  1 16    1.  No licensee shall lease as lessor, and no A person
  1 17 shall lease as not be lessee, a party to a lease of a breeding
  1 18 bull within this state in which the lessor is a licensee,
  1 19 unless such the breeding bull is accompanied by a health
  1 20 certificate signed.  For the purposes of this section, a
  1 21 breeding bull is leased within this state if it is leased to
  1 22 an Iowa resident.
  1 23    2.  The health certificate shall be issued by a licensed
  1 24 veterinarian and showing who examines the breeding bull and
  1 25 signs the health certificate.  The health certificate shall
  1 26 include all of the following:
  1 27    1.  That the breeding bull has been tested by a licensed
  1 28 veterinarian within sixty days prior to rental and found to be
  1 29 free from Bang's disease, and tuberculosis.
  1 30    2. a.  That, A statement that to the best of the knowledge
  1 31 and belief of the examining licensed veterinarian, the
  1 32 breeding bull is apparently free from any infectious,
  1 33 contagious, or communicable disease.
  1 34    b.  A statement that the breeding bull has reacted
  1 35 negatively to a test for brucellosis conducted within six
  2  1 months prior to the date that the veterinarian signs the
  2  2 health certificate.
  2  3    c.  If the breeding bull does not originate from this
  2  4 state, a statement that importing the breeding bull satisfies
  2  5 applicable importation requirements.
  2  6    3. d.  The identification number of the breeding bull
  2  7 tested and the as required pursuant to section 163.42.
  2  8    e.  The date of issuance of that the health certificate is
  2  9 issued.
  2 10    3.  Such The health certificate shall not be valid for one
  2 11 rental on one premise only after the term of the lease expires
  2 12 or after the breeding bull moves from the lessee's premises.
  2 13 Thereafter, a new health certificate must be issued after the
  2 14 breeding bull has been retested; but no new test for
  2 15 tuberculosis shall be required if the breeding bull is leased
  2 16 within sixty days of the last tuberculosis test as required in
  2 17 this section.
  2 18    4.  One copy of the health certificate shall be filed with
  2 19 the department within fourteen days after its issuance; and
  2 20 one issued to the licensee who shall maintain the health
  2 21 certificate as part of the licensee's business records.  One
  2 22 copy of the health certificate shall be issued to the lessee
  2 23 when the breeding bull is delivered to the lessee.  A licensee
  2 24 shall show the health certificate of any breeding bull upon
  2 25 the request of to any person designated by the department to
  2 26 enforce the provisions of this division section.  The licensee
  2 27 shall also, within ten days after the lease of each breeding
  2 28 bull, notify the department in writing of the name and address
  2 29 of the person to whom the breeding bull is being leased,
  2 30 together with the date of delivery.
  2 31    For the purposes of this section, a breeding bull is leased
  2 32 within this state if it is leased to an Iowa resident.
  2 33    Sec. 3.  Section 163.46, Code 1999, is amended to read as
  2 34 follows:
  2 35    163.46  SALE OF SEMEN.
  3  1    It shall be unlawful for the The owner of any a breeding
  3  2 bull located within this state to shall not sell the semen
  3  3 from that bull for the purpose of artificial insemination
  3  4 unless that person has the owner is in possession of a signed
  3  5 health certificate signed and issued by a licensed
  3  6 veterinarian within twelve six months before the date the
  3  7 semen was is collected, provided the.  The health certificate
  3  8 shall not be valid if the bull had not been is moved to any
  3  9 other premise another premises between the date of examination
  3 10 and the date of collection, showing.  The health certificate
  3 11 shall show that on the date of issue the breeding bull had
  3 12 been tested negative for tuberculosis and Bang's disease
  3 13 brucellosis and, to the best knowledge and belief of the
  3 14 examining veterinarian, was apparently free from any
  3 15 infectious, contagious, or communicable disease.  If a
  3 16 breeding bull is moved to any other premise after issuance of
  3 17 the health certificate but prior to collection of the semen,
  3 18 that health certificate shall be invalid for purposes of this
  3 19 section.
