PAG LIN 1 1 Section 1. Section 206.2, Code 1999, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 10A. "Family member" means a person 1 4 related to another person as a spouse, parent, grandparent, 1 5 child, grandchild, or sibling. 1 6 Sec. 2. Section 206.5, subsection 3, paragraph a, Code 1 7 1999, is amended to read as follows: 1 8 a. A commercial applicator shall choose between a one-year 1 9 certification for which the applicator shall pay a thirty 1 10 dollar fee or a three-year certification for which the 1 11 applicator shall pay a seventy-five dollar fee. A public 1 12 applicator shall choose between a one-year certification for 1 13 which the applicator shall pay a ten dollar fee or a three- 1 14 year certification for which the applicator shall pay a 1 15 fifteen dollar fee. A private applicator shall pay a fifteen 1 16 dollar fee for a three-year certification. If a person and 1 17 one or more family members is certified as a private 1 18 applicator upon concurrently completing an educational program 1 19 as required pursuant to this subsection, the required amount 1 20 paid for the person's certification shall also satisfy the 1 21 amount of the certification fee otherwise required to be paid 1 22 for each of the family members. 1 23 Sec. 3. Section 455B.203A, subsection 1, Code Supplement 1 24 1999, is amended by adding the following new paragraph: 1 25 NEW PARAGRAPH. d. "Family member" means a person related 1 26 to another person as a spouse, parent, grandparent, child, 1 27 grandchild, or sibling. 1 28 Sec. 4. Section 455B.203A, subsection 6, paragraph a, Code 1 29 Supplement 1999, is amended to read as follows: 1 30 a. The department may charge a fee for certifyingpersons1 31 a person under this section. The fee for certification shall 1 32 be based on the costs of administering and enforcing this 1 33 section and paying the expenses of the department relating to 1 34 certification. If a person and one or more family members is 1 35 certified as a confinement site manure applicator upon 2 1 concurrently completing an educational program as required 2 2 pursuant to this section, the required amount paid for the 2 3 person's certification shall also satisfy the amount of the 2 4 certification fee otherwise required to be paid for each of 2 5 the family members. 2 6 EXPLANATION 2 7 This bill amends two provisions which relate to 2 8 certification of persons who apply restricted use pesticides 2 9 or manure stored at the site of a confinement feeding 2 10 operation, and who are not in the application business 2 11 typically agricultural producers. The educational program for 2 12 private pesticide applicators (referred to as "private 2 13 applicators") is administered by the department of agriculture 2 14 and land stewardship. The educational program for confinement 2 15 site manure applicators is administered by the department of 2 16 natural resources. In both cases, persons must be certified 2 17 after completing an educational program and paying a fee. 2 18 This bill provides if a person and one or more family 2 19 members is certified as a private applicator of pesticides 2 20 under Code section 206.5 or a confinement site manure 2 21 applicator under Code section 455B.203A, upon concurrently 2 22 completing an educational program as provided under those 2 23 sections, the required amount paid for the person's 2 24 certification shall also satisfy the amount of the 2 25 certification fee otherwise required to be paid for each of 2 26 the family members. 2 27 The bill defines a "family member" as a person related to 2 28 another person as a spouse, parent, grandparent, child, 2 29 grandchild, or sibling. 2 30 LSB 5246HH 78 2 31 da/cf/24
