  1  1    Section 1.  Section 257.31, subsection 17, Code 1999, is
  1  2 amended to read as follows:
  1  3    17.  a.  If a district's average transportation costs per
  1  4 pupil exceed the state average transportation costs per pupil
  1  5 determined under paragraph "c" by one hundred fifty percent,
  1  6 the committee may grant transportation assistance aid to the
  1  7 district pursuant to rules adopted by the committee.  Such aid
  1  8 shall be miscellaneous income and shall not be included in
  1  9 district cost.
  1 10    b.  To be eligible for transportation assistance aid, a
  1 11 school district shall annually certify its actual cost for all
  1 12 children transported in all school buses not later than July
  1 13 31 after each school year on forms prescribed by the
  1 14 committee.
  1 15    c.  A district's average transportation costs per pupil
  1 16 shall be determined by dividing the district's actual cost for
  1 17 all children transported in all school buses for a school year
  1 18 pursuant to section 285.1, subsection 12, less the amount
  1 19 received for transporting nonpublic school pupils under
  1 20 section 285.1, by the district's actual enrollment for the
  1 21 school year excluding the shared-time enrollment for the
  1 22 school year as defined in section 257.6.  The state average
  1 23 transportation costs per pupil shall be determined by dividing
  1 24 the total actual costs for all children transported in all
  1 25 districts for a school year, by the total of all districts'
  1 26 actual enrollments for the school year.
  1 27    d.  There is appropriated from the general fund of the
  1 28 state to the committee, for each fiscal year, an amount
  1 29 sufficient to pay the transportation assistance aid to school
  1 30 districts as provided in this subsection.  Funds transferred
  1 31 to the committee in accordance with section 321.34, subsection
  1 32 22, are also appropriated to the committee and may be expended
  1 33 for the purposes of the committee, as described in this
  1 34 section this subsection.  However, highest priority shall be
  1 35 given to districts that meet the conditions described in this
  2  1 subsection.  Notwithstanding any other provision of the Code,
  2  2 unencumbered or unobligated funds appropriated to the
  2  3 committee pursuant to this paragraph or transferred to the
  2  4 committee pursuant to section 321.34, subsection 22, remaining
  2  5 on June 30 of the fiscal year for which the funds were
  2  6 appropriated or transferred, shall not revert but shall be
  2  7 available for expenditure for the purposes of this subsection
  2  8 in subsequent fiscal years.
  2  9    e.  The committee shall adopt rules pursuant to chapter 17A
  2 10 for granting transportation assistance aid and for otherwise
  2 11 administering this subsection.  
  2 12                           EXPLANATION
  2 13    This bill appropriates funds each year beginning July 1,
  2 14 2000, to the school budget review committee in an amount
  2 15 sufficient to pay transportation assistance aid to school
  2 16 districts which have average transportation costs per pupil
  2 17 that exceed the state average transportation costs per pupil
  2 18 by 150 percent.  Rules relating to granting such aid are to be
  2 19 adopted by the committee pursuant to Code chapter 17A.
  2 20 Currently, the school budget review committee receives funds
  2 21 for the transportation assistance aid from fees for special
  2 22 motor vehicle registration plates with education emblems
  2 23 pursuant to Code section 321.34.
