1 1 Section 1. Section 249A.3, Code Supplement 1999, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 14. Beginning October 1, 2000, in
1 4 determining the eligibility of an institutionalized individual
1 5 for assistance under this chapter, the department shall allow
1 6 a deduction from the individual's total income for the
1 7 following amounts for incurred expenses for medical or
1 8 remedial care that are not subject to payment by a third
1 9 party, in accordance with 42 C.F.R., } 435.725, including all
1 10 of the following:
1 11 a. Medicare and other health insurance premiums,
1 12 deductibles, or coinsurance charges.
1 13 b. Necessary medical or remedial care as defined by rule
1 14 of the department which is not covered under this state's
1 15 medical assistance plan, subject to reasonable amount
1 16 limitations which the department may establish by rule.
1 17 EXPLANATION
1 18 This bill provides that in determining eligibility for
1 19 medical assistance for an institutionalized individual, the
1 20 department is required to allow a deduction from the
1 21 individual's total income for expenses incurred by the
1 22 individual for medical or remedial care that is not subject to
1 23 payment by a third party. The allowable expenses may include
1 24 Medicare and other health insurance premiums, deductibles, or
1 25 coinsurance charges and necessary medical or remedial care as
1 26 defined by rule, which are not included in the state's medical
1 27 assistance plan, subject to reasonable amount limitations
1 28 established by rule of the department of human services.
