  1  1    Section 1.  NEW SECTION.  321.447  RIDING IN AREA NOT
  1  2 INTENDED FOR PASSENGERS PROHIBITED.
  1  3    A person shall not ride and an operator shall not allow a
  1  4 person to ride in an area of a motor vehicle not designed or
  1  5 intended for passenger seating when the motor vehicle is in
  1  6 motion.  This section does not apply in any of the following
  1  7 circumstances:
  1  8    1.  The motor vehicle is operated in a parade authorized by
  1  9 proper permit from local authorities.
  1 10    2.  The motor vehicle is being operated for agricultural
  1 11 purposes.
  1 12    3.  The motor vehicle is an authorized emergency vehicle.
  1 13    Sec. 2.  Section 321.455, Code 1999, is amended to read as
  1 14 follows:
  1 15    321.455  PROJECTING LOADS ON PASSENGER VEHICLES.
  1 16    No A passenger-type vehicle shall not be operated on any
  1 17 highway with any load carried thereon on the vehicle extending
  1 18 beyond the line of the fenders on the left side of such
  1 19 vehicle nor or extending more than six inches beyond the line
  1 20 of the fenders on the right side thereof of such vehicle.
  1 21 Passengers shall not ride on any part of any vehicle unless it
  1 22 is expressly designed either for passenger use or designed for
  1 23 carrying livestock, merchandise, or freight.
  1 24    Sec. 3.  Section 805.8, subsection 2, Code Supplement 1999,
  1 25 is amended by adding the following new paragraph:
  1 26    NEW PARAGRAPH.  ai.  For riding in an area of a motor
  1 27 vehicle not designed or intended for passenger seating or
  1 28 allowing a person to ride in such an area of a motor vehicle
  1 29 in violation of section 321.447, the scheduled fine is twenty-
  1 30 five dollars.  
  1 31                           EXPLANATION
  1 32    This bill creates new Code section 321.447 which prohibits
  1 33 a person from riding and prohibits an operator from allowing a
  1 34 person to ride in an area of a motor vehicle not designed or
  1 35 intended for passenger seating when the motor vehicle is in
  2  1 motion.  The prohibition does not apply to operation of the
  2  2 motor vehicle in an authorized parade, while the motor vehicle
  2  3 is being operated for agricultural purposes, or if the motor
  2  4 vehicle is an authorized emergency vehicle.  A violation of
  2  5 either of the prohibitions is punishable by a scheduled fine
  2  6 of $25.
  2  7    The bill also makes a corresponding amendment to Code
  2  8 section 321.455 by striking a provision prohibiting passengers
  2  9 from riding on a vehicle unless it is designed for passenger
  2 10 use or for carrying livestock, merchandise, or freight.
