PAG LIN 1 1 Section 1. Section 256D.8, subsections 1 and 3, Code 1 2 Supplement 1999, are amended to read as follows: 1 3 1. Except as provided in subsection 2, a school district 1 4 shall expend funds received pursuant to section 256D.5, 1 5 subsection 2, for the acquisition, lease, lease-purchase, 1 6 installation, and maintenance of instructional technology 1 7 equipment, including hardware and software, materials and 1 8 supplies related to instructional technology, and staff 1 9 development and training related to instructional technology, 1 10 and shall establish priorities for the use of the funds. 1 11 However, funds received by a school district pursuant to 1 12 section 256D.5, subsection 2, shall not be expended to add a 1 13 full-time equivalent position or otherwise increase staffing, 1 14 except to employ computer technical support personnel. 1 15 3. Funds received by an area education agency pursuant to 1 16 section 256D.6, subsection 2, shall be expended for the costs 1 17 related to supporting school districts within the area served 1 18 with technology planning and equipment, including hardware and 1 19 software, materials and supplies related to instructional 1 20 technology, employment of computer technical support 1 21 personnel, and staff development and training related to 1 22 instructional technology. 1 23 Sec. 2. Section 295.4, Code 1999, is amended to read as 1 24 follows: 1 25 295.4 SCHOOL IMPROVEMENT AND TECHNOLOGY EXPENDITURES. 1 26 1. School districts, as defined in section 295.2, 1 27 subsection 8, shall expend funds received pursuant to section 1 28 295.2 for the acquisition, lease, lease-purchase, 1 29 installation, and maintenance of instructional technology 1 30 equipment, including hardware and software, materials and 1 31 supplies related to instructional technology, and staff 1 32 development and training related to instructional technology, 1 33 and shall establish priorities for the use of the funds. 1 34 However, funds received by a school district pursuant to 1 35 section 295.2 shall not be expended to add a full-time 2 1 equivalent position or otherwise increase staffing, except to 2 2 employ computer technical support personnel. 2 3 2. Funds received by an area education agency pursuant to 2 4 section 295.2 shall be expended for the costs related to 2 5 supporting school districts within the area served with 2 6 technology planning and equipment, including hardware and 2 7 software, materials and supplies related to instructional 2 8 technology, employment of computer technical support 2 9 personnel, and staff development and training related to 2 10 instructional technology. 2 11 EXPLANATION 2 12 This bill permits a school district or area education 2 13 agency to use state school improvement technology funds to 2 14 employ computer technical support personnel. 2 15 Code chapter 295, which establishes the school improvement 2 16 and technology program and sunsets on June 30, 2001, and Code 2 17 chapter 256D, which establishes the school improvement 2 18 technology block grant program and funds the program from 2 19 fiscal year 2001-2002 through 2002-2003, both use similar 2 20 language to set forth permissible expenditures of funds 2 21 received by school districts and area education agencies under 2 22 the programs. Currently, language in the Code prohibits 2 23 school districts from using technology funds to add a full- 2 24 time equivalent position or otherwise increase staffing. The 2 25 current Code language does not specifically prohibit or permit 2 26 an area education agency from using its technology funds to 2 27 increase staffing. 2 28 LSB 5365HH 78 2 29 kh/gg/8
