1 1 Section 1. CHILD SUPPORT – LOCAL DISBURSEMENT UNITS –
1 2 DIRECTIVE.
1 3 1. The director of the department of human services shall
1 4 seek the agreement of the United States secretary of health
1 5 and human services in meeting the requirements of 42 U.S.C. }
1 6 654b relating to the establishment and operation of a state
1 7 disbursement unit for child support collection and
1 8 disbursement, by allowing for the linkage of local
1 9 disbursement units in accordance with 42 U.S.C. } 654b(a)(3).
1 10 The director shall demonstrate to the secretary that the
1 11 system will cost no more and would take no more time to
1 12 establish or operate than a centralized system and that the
1 13 system will provide one location to which income withholding
1 14 may be sent by employers.
1 15 2. If the United States secretary of health and human
1 16 services agrees to use of the linkage of local disbursement
1 17 units, the department of human services shall implement the
1 18 localized system.
1 19 EXPLANATION
1 20 This bill directs the state director of human services to
1 21 seek the agreement of the United States secretary of health
1 22 and human services to allow the state to establish and operate
1 23 a network of local collection and disbursement units in place
1 24 of the centralized disbursement unit required under federal
1 25 law. The federal law (42 U.S.C. } 654b(a)(3)) provides that
1 26 local disbursement units may be used if the secretary agrees
1 27 that the localized system would not cost more and would take
1 28 no more time to establish or operate than a centralized
1 29 system. One condition of the exception is that employers be
1 30 provided one location to which to send income withholding. If
1 31 agreement is provided, the department is to implement the
1 32 localized system.
