  1  1    Section 1.  Section 633.219, subsections 5 and 6, Code
  1  2 1999, are amended to read as follows:
  1  3    5.  If there is no person to take under subsection 1, 2, 3,
  1  4 or 4 of this section, and the decedent is survived by one or
  1  5 more great-grandparents or issue of great-grandparents, the
  1  6 estate passes equally to each set of great-grandparents, or to
  1  7 their issue, if any survive, per stirpes.
  1  8    6.  If there is no person to take under subsection 1, 2, 3,
  1  9 or 4, or 5 of this section, the portion uninherited shall go
  1 10 to the issue of the deceased spouse of the intestate, per
  1 11 stirpes.  If the intestate has had more than one spouse who
  1 12 died in lawful wedlock, it shall be equally divided between
  1 13 the issue, per stirpes, of those deceased spouses.
  1 14    6. 7.  If there is no person who qualifies under either
  1 15 subsection 1, 2, 3, 4, or 5, or 6 of this section, the
  1 16 intestate property shall escheat to the state of Iowa.  
  1 17                           EXPLANATION
  1 18    This bill amends the Code section relating to the rules of
  1 19 inheritance for intestate succession to provide for
  1 20 inheritance by great-grandparents or descendants of great-
  1 21 grandparents (great-aunts and uncles and second cousins) when
  1 22 no descendants, parents, siblings or descendants of siblings,
  1 23 grandparents or descendants of grandparents (aunts and uncles
  1 24 and first cousins) are available to inherit from an intestate
  1 25 decedent.
