  1  4 RELATING TO THE CONSTRUCTION OR ACQUISITION OF
  1  5    INFRASTRUCTURE BY RURAL WATER DISTRICTS BY PROVIDING
  1  6    FOR FINANCING AND EXEMPTING CERTAIN DEBT INSTRUMENTS 
  1  7    FROM TAXATION.

  1  9 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 10 
  1 11    Section 1.  Section 357A.11, subsection 9, Code 1999, is
  1 12 amended to read as follows:
  1 13    9.  Finance all or part of the cost of the construction or
  1 14 purchase of a project necessary to carry out the purposes for
  1 15 which the district is incorporated or to refinance all or part
  1 16 of the original cost of that project, including, but not
  1 17 limited to, obligations originated by the district as a
  1 18 nonprofit corporation under chapter 504A and assumed by the
  1 19 district reorganized under this chapter.  Financing or
  1 20 refinancing carried out under this subsection shall be in
  1 21 accordance with the terms and procedures set forth in the
  1 22 applicable provisions of sections 384.24A, 384.83 through
  1 23 384.88, 384.92, and 384.93.  References in these sections to a
  1 24 city shall be applicable to a rural water district operating
  1 25 under this chapter, and references in that division to a city
  1 26 council shall be applicable to the board of directors of a
  1 27 rural water district.  This subsection shall not create a lien
  1 28 against the property of a person who is not a rural water
  1 29 subscriber.
  1 30    Sec. 2.  Section 357A.15, unnumbered paragraph 1, Code
  1 31 1999, is amended to read as follows:
  1 32    No A district shall not have any power to levy any taxes.
  1 33 Neither the The facilities constructed or otherwise acquired
  1 34 by any a district, including but not limited to ponds,
  1 35 reservoirs, pipelines, wells, check dams, and pumping
  2  1 installations, the revenues obtained by the district from the
  2  2 sale of water, nor and the revenue bonds or notes, or interest
  2  3 therefrom from the revenue bonds or notes, issued by any a
  2  4 district shall not be taxable in any manner by the state of
  2  5 Iowa or any of its political subdivisions.
