  1  1    Section 1.  Section 123.179, subsection 2, Code 1999, is
  1  2 amended by striking the subsection and inserting in lieu
  1  3 thereof the following:
  1  4    2.  The annual permit fee for a class "B" wine permit shall
  1  5 be graduated according to population as follows:
  1  6    a.  For premises located within the corporate limits of
  1  7 cities having a population of ten thousand or more, five
  1  8 hundred dollars.
  1  9    b.  For premises located within the corporate limits of
  1 10 cities having a population of at least one thousand five
  1 11 hundred but less than ten thousand, three hundred dollars.
  1 12    c.  For premises located within the corporate limits of
  1 13 cities having a population of less than one thousand five
  1 14 hundred, one hundred fifty dollars.
  1 15    d.  For premises located outside the corporate limits of
  1 16 any city, a sum equal to that charged in the city located
  1 17 nearest the premises to be operated under the permit, and if
  1 18 there is doubt as to which of two or more differing corporate
  1 19 limits is the nearest, the permit fee which is the largest
  1 20 shall prevail.  However, if the premises are located in an
  1 21 unincorporated town, for purposes of this subsection the
  1 22 unincorporated town shall be considered a city.  
  1 23                           EXPLANATION
  1 24    This bill provides a graduated fee structure for class "B"
  1 25 wine permits.  A class "B" permit allows the holder to sell
  1 26 wine at retail for consumption off the premises.  Under
  1 27 current law, all holders of a class "B" wine permit pay the
  1 28 same annual fee of $500.
  1 29    Under this bill, the holder of a wine permit located in a
  1 30 city having of population of 10,000 or more will pay $500
  1 31 annually; the holder of a wine permit located in a city having
  1 32 of population of at least 1,500 but not more than 10,000 will
  1 33 pay a fee of $300 annually; and the holder of a wine permit
  1 34 located in a city having a population of less than 1,500 will
  1 35 pay $150 annually.  A wine permit holder located in an area
  2  1 outside the boundaries of a city will pay an amount equal to
  2  2 that charged in the city located nearest to the premises to be
  2  3 operated under the wine permit.
