    14    LISHING A NATIONAL BOARD CERTIFICATION PILOT PROJECT, AND
    18    REQUIRING STUDIES BY THE DEPARTMENT OF EDUCATION.

    32    Section 1.  Section 256.44, Code 1999, is amended by
    36 striking the section and inserting in lieu thereof the
    46 following:
    56    256.44  NATIONAL BOARD CERTIFICATION PILOT PROJECT.
    66    1.  A national board certification pilot project is
    76 established to be administered by the department of education.
    86 A teacher, as defined in section 272.1, who registers for or
    96 achieves national board for professional teaching standards
   106 certification, and who is employed by a school district in
   116 Iowa and receiving a salary as a classroom teacher, may be
   126 eligible for the following:
   136    a.  If a teacher registers for national board for
   146 professional teaching standards certification prior to June
   156 30, 2002, a one-time initial reimbursement award in the amount
   166 of up to one-half of the registration fee paid by the teacher
   176 for registration for certification by the national board for
   186 professional teaching standards.  The teacher shall apply to
   196 the department of education within one year of registration,
   206 submitting to the department any documentation the department
   216 requires.  A teacher who receives an initial reimbursement
   226 award shall receive a one-time final registration award in the
   236 amount of the remaining national board registration fee paid
   246 by the teacher if the teacher notifies the department of the
   256 teacher's certification achievement and submits any
   266 documentation requested by the department.
   276    b.  (1)  If, by May 1, 2000, the teacher applies to the
   286 department for an annual award and submits documentation of
   296 certification by the national board for professional teaching
   306 standards, an annual award in the amount of five thousand
   316 dollars.  However, if the teacher does not achieve
   326 certification on the teacher's first attempt to pass the
   336 national board for professional teaching standards assessment,
   346 the teacher shall be paid the award amount as provided in
   356 subparagraph (2) upon achieving certification.  The department
   366 shall award not more than a total of fifty thousand dollars in
   376 annual awards to an individual during the individual's term of
   386 eligibility for annual awards.
   396    (2)  If the teacher registers for national board for
   406 professional teaching standards certification between January
   416 1, 1999, and January 1, 2002, and achieves certification
   426 within three years from the date of initial score
   436 notification, an annual award in the amount of two thousand
   446 five hundred dollars upon achieving certification by the
   456 national board of professional teaching standards.
   466    To receive an annual award pursuant to this paragraph "b",
   476 a teacher shall apply to the department for an award within
   486 one year of eligibility.  Payment for awards shall be made
   496 only upon departmental approval of an application or
   506 recertification of eligibility.  A term of eligibility shall
   516 be for ten years or for the years in which the individual
   526 maintains a valid certificate, whichever time period is
   536 shorter.  In order to continue receipt of payments, a
   546 recipient shall annually recertify eligibility.
   556    2.  a.  If the amount appropriated annually for purposes of
   566 this section is insufficient to pay the full amount of
   576 reimbursement awards in accordance with subsection 1,
   586 paragraph "a", the department shall annually prorate the
   596 amount of the registration awards provided to each teacher who
   606 meets the requirements of this section.
   616    b.  If the amount appropriated annually for purposes of
   626 providing an annual award in accordance with subsection 1,
   636 paragraph "b", is insufficient to pay the full annual award to
   646 all teachers approved by the department for an annual award,
   656 the department shall prorate the amount of the annual award
   666 based upon the amount appropriated.
   676    3.  A teacher receiving an annual award pursuant to this
   686 section may provide additional services to the school district
   696 that employs the teacher.  The additional services to be
   706 provided by the teacher may be mutually agreed upon by the
   716 school district and the teacher.
   726    4.  Awards shall be paid to teachers by the department as
   736 follows:
   746    a.  Upon receipt of reimbursement documentation as provided
   756 in subsection 1, paragraph "a".
   766    b.  Not later than June 1 to teachers whose applications
   776 and recertifications for annual awards as provided in
   786 subsection 1, paragraph "b", are submitted to the department
   796 by May 1 and subsequently approved.
   806    5.  Notwithstanding any provision to the contrary, a
   816 teacher approved by the department to receive an annual award
   826 for certification in accordance with this section in the
   836 fiscal year beginning July 1, 1998, shall receive the annual
   846 award amount specified in subsection 1, paragraph "b",
   856 subparagraph (1), to commence with the fiscal year beginning
   866 July 1, 1999.
   876    6.  From funds appropriated for purposes of this section by
   886 the general assembly to the department of education for each
   896 fiscal year in the fiscal period beginning July 1, 1999, and
   906 ending June 30, 2004, three hundred thousand dollars, or so
   916 much thereof as may be necessary, shall be used for the
   926 payment of registration awards as provided in subsection 4,
   936 paragraph "a".
   946    7.  The department shall prorate the amount of the annual
   956 awards paid in accordance with this section when the number of
   966 award recipients exceeds one thousand one hundred individuals.
   976    Sec. 2.  DEPARTMENT OF EDUCATION STUDIES.  The department
   986 of education shall conduct a study of the effects of the
   996 national board certification pilot project established in
  1006 section 256.44 on teaching quality, professional development,
  1016 the provision of additional services to school districts in
  1026 accordance with section 256.44, subsection 3, and teacher
  1036 induction and retention in this state.  The department shall
  1046 consider whether the effects of the pilot project support
  1056 continuation of the project or expansion to include other
  1066 teacher awards or recognitions.  The department shall submit
  1076 its findings and recommendations in a report to the
  1086 chairpersons and ranking members of the senate and house
  1096 standing committees on education and the joint subcommittee on
  1106 education appropriations by December 1, 2001.
  1116    Sec. 3.  EMERGENCY RULES.  The department of education may
  1126 adopt emergency rules under section 17A.4, subsection 2, and
  1136 section 17A.5, subsection 2, paragraph "b", to implement the
  1146 provisions of this Act and the rules shall be effective
  1156 immediately upon filing unless a later date is specified in
  1166 the rules.  Any rules adopted in accordance with this section
  1176 shall also be published as a notice of intended action as
  1186 provided in section 17A.4.
