80 RELATING TO THE IOWA EGG COUNCIL BY PROVIDING FOR ITS
82 ADMINISTRATION AND MEMBERSHIP, AND PROVIDING AN

120 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

150 Section 1. Section 184.7, subsections 1 and 2, Code 1999,
146 are amended to read as follows:
148 1. A person shall serve as a member on the council for a
150 term of three years. A person may serve as a member on the
152 council for more than one term. However, if a person serves
154 for two complete consecutive terms, the person must wait at
156 least twelve months prior to serving another term.
158 2. The council shall elect a chairperson, and other
160 officers as needed, from among its voting members who shall
162 serve for a one-year term, and may be reelected to serve
164 subsequent terms according to procedures adopted by the
166 council.
168 Sec. 2. Section 184.10, unnumbered paragraph 1, Code 1999,
170 is amended to read as follows:
172 The Iowa egg council may do all perform any function
174 related to the production and marketing of eggs or egg
176 products, including but not limited to doing any of the
178 following:
180 Sec. 3. Section 184.10, Code 1999, is amended by adding
182 the following new subsections:
184 NEW SUBSECTION. 6. Become a dues-paying member of an
186 organization carrying out a purpose related to the increased
188 consumption and utilization of eggs or egg products.
190 NEW SUBSECTION. 7. Fund research and education programs
192 directed toward better and more efficient production,
194 marketing, and utilization of eggs and egg products.
196 Sec. 4. Section 184.11, subsections 1 and 2, Code 1999,
198 are amended by striking the subsections.
200 Sec. 5. Section 184.11, subsections 3 and 4, Code 1999,
202 are amended by striking the subsections and inserting in lieu
204 thereof the following:
206 3. Execute a contract or act as an agent of a person who
208 executes a contract for any of the following:
210 a. Selling eggs or egg products.
212 b. Selling equipment used in the manufacturing of egg
214 products.
216 Sec. 6. Section 184.12, Code 1999, is amended to read as
218 follows:
220 184.12 COMPENSATION.
222 Members of the council may receive payment for their actual
224 expenses and travel in performing official council functions.
226 Payment shall be made from amounts collected from the
228 assessment. A voting member of the council shall not be a
230 salaried employee of the council or any organization or agency
232 receiving moneys from the council.
234 Sec. 7. Section 184.15, Code 1999, is amended to read as
236 follows:
238 184.15 BOND REQUIRED.
240 All The council shall provide a bond for all persons
242 holding positions of trust under this chapter shall provide a
244 bond in an amount required by the council. The premiums for
246 bond costs shall be paid from moneys transferred from the Iowa
248 egg fund to the council as provided in section 184.13.
250 Sec. 8. EFFECTIVE DATE. This Act, being deemed of
252 immediate importance, takes effect upon enactment.
