  1  4 PROVIDING REGISTRATION REQUIREMENTS AND ESTABLISHING A SCOPE
  1  5    OF AUTHORITY FOR DENTAL ASSISTANTS, AND PROVIDING AN
  1  6    EFFECTIVE DATE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 147.13, subsection 8, Code 1999, is
  1 11 amended to read as follows:
  1 12    8.  For dentistry, and dental hygiene, and dental
  1 13 assisting, dental examiners.
  1 14    Sec. 2.  Section 147.80, Code 1999, is amended by adding
  1 15 the following new subsection:
  1 16    NEW SUBSECTION.  27A.  Registration to practice as a dental
  1 17 assistant, registration to practice as a dental assistant
  1 18 under a reciprocal agreement, or renewal of registration to
  1 19 practice as a dental assistant.
  1 20    Sec. 3.  Section 153.14, subsection 1, Code 1999, is
  1 21 amended to read as follows:
  1 22    1.  Students of dentistry who practice dentistry upon
  1 23 patients at clinics in connection with their regular course of
  1 24 instruction at the state dental college and students of dental
  1 25 hygiene who practice upon patients at clinics in connection
  1 26 with their regular course of instruction at state-approved
  1 27 schools, and students of dental assisting who practice upon
  1 28 patients at clinics in connection with a regular course of
  1 29 instruction determined by the board of dentistry pursuant to
  1 30 section 153.39.
  1 31    Sec. 4.  Section 153.14, Code 1999, is amended by adding
  1 32 the following new subsection:
  1 33    NEW SUBSECTION.  5.  Persons registered to practice as a
  1 34 dental assistant.
  1 35    Sec. 5.  NEW SECTION.  153.38  DENTAL ASSISTANTS – SCOPE
  2  1 OF TERM.
  2  2    A registered dental assistant may perform those services of
  2  3 assistance to a licensed dentist as determined by the board of
  2  4 dentistry by rule.  Such services shall be performed under
  2  5 supervision of a licensed dentist in a dental office, a public
  2  6 or private school, public health agencies, hospitals, and the
  2  7 armed forces, but shall not be construed to authorize a dental
  2  8 assistant to practice dentistry or dental hygiene.  Every
  2  9 licensed dentist who utilizes the services of a registered
  2 10 dental assistant for the purpose of assistance in the practice
  2 11 of dentistry shall be responsible for acts delegated to the
  2 12 registered dental assistant.  A dentist shall delegate to a
  2 13 registered dental assistant only those acts which are
  2 14 authorized to be delegated to registered dental assistants by
  2 15 the board of dentistry.
  2 16    Sec. 6.  NEW SECTION.  153.39  DENTAL ASSISTANTS –
  2 17 REGISTRATION REQUIREMENTS, RENEWAL, REVOCATION, OR SUSPENSION.
  2 18    1.  A person shall not practice on or after July 1, 2001 as
  2 19 a dental assistant unless the person has registered with the
  2 20 board and received a certificate of registration pursuant to
  2 21 this chapter.
  2 22    2.  A person shall be registered upon the successful
  2 23 completion of education and examination requirements.
  2 24 Education requirements shall be determined by the board by
  2 25 rule, and may be satisfied either through a formal series of
  2 26 classes or through job equivalency training, according to
  2 27 standards to be determined by the board.  The education
  2 28 requirements may include possession of a valid certificate in
  2 29 a nationally recognized course in cardiopulmonary
  2 30 resuscitation.  Successful passage of an examination
  2 31 administered by the board, which shall include sections
  2 32 regarding infection control, hazardous materials, and
  2 33 jurisprudence, shall also be required.  The board shall
  2 34 establish continuing education requirements as a condition of
  2 35 renewing registration as a registered dental assistant, as
  3  1 well as standards for the suspension or revocation of
  3  2 registration.
  3  3    3.  Individuals employed as a dental assistant as of July
  3  4 1, 2001, shall be registered with the board and receive a
  3  5 certificate of registration, and individuals employed as a
  3  6 dental assistant after July 1, 2001, shall have a sixty-day
  3  7 period following their first date of employment after July 1,
  3  8 2001, to comply with the provisions of subsection 1.
  3  9    Sec. 7.  LEGISLATIVE INTENT.  It is the intent of the
  3 10 general assembly that the board of dental examiners adopt
  3 11 rules authorized pursuant to sections 5 and 6 of this Act, to
  3 12 be adopted on or before January 1, 2001.  The board shall
  3 13 consider, in adopting rules, recommendations of the scope of
  3 14 practice review committee relating to practice as a dental
  3 15 assistant.  The board shall not, however, adopt rules that
  3 16 delegate to a dental assistant any of the following services:
  3 17    1.  Administration of local anesthesia.
  3 18    2.  Placement of sealants.
  3 19    3.  Removal of any plaque, stain, calculus, or hard natural
  3 20 or synthetic material except by toothbrush, floss, or rubber
  3 21 cup coronal polish.
  3 22    Sec. 8.  EFFECTIVE DATE.  Section 7 of this Act, being
  3 23 deemed of immediate importance, takes effect upon enactment
  3 24 for the purpose of developing rules for adoption on or before
  3 25 January 1, 2001.
