PAG LIN 1 1 Section 1. NEW SECTION. 709.15A SEXUAL EXPLOITATION BY A 1 2 PERSON IN AUTHORITY. 1 3 1. For purposes of this section, unless the context 1 4 otherwise requires: 1 5 a. "Person in authority" means a person who is twenty-one 1 6 years of age or older and has supervisory or other authority 1 7 over a person who is sixteen or seventeen years of age. A 1 8 person in authority includes but is not limited to an 1 9 educational practitioner issued a license, certificate, or 1 10 authorization under chapter 272, a peace officer, a member of 1 11 the clergy, or an employer or job supervisor. 1 12 b. "Sexually exploits" means engaging in conduct that is 1 13 for the purpose of arousing or satisfying the sexual desires 1 14 of a person in authority or a person sixteen or seventeen 1 15 years of age and includes but is not limited to kissing; 1 16 touching of the clothed or unclothed inner thigh, breast, 1 17 groin, buttock, anus, pubes, or genitals; or committing a sex 1 18 act as defined in section 702.17. 1 19 2. A person in authority who sexually exploits a person 1 20 sixteen or seventeen years of age commits an aggravated 1 21 misdemeanor. 1 22 EXPLANATION 1 23 This bill establishes the crime of sexual exploitation of a 1 24 minor who is age 16 or 17 by a person who is age 21 or older 1 25 and has supervisory or other authority over the minor. A 1 26 person in authority includes an educational practitioner who 1 27 is licensed or who has been issued a certificate or 1 28 authorization under the state licensing provisions in Code 1 29 chapter 272, a peace officer, a member of the clergy, or an 1 30 employer or job supervisor. 1 31 The bill's provisions would be codified as new Code section 1 32 709.15A in the sexual abuse Code chapter. The crime of sexual 1 33 exploitation by a person in authority is punishable as an 1 34 aggravated misdemeanor (maximum penalty of a prison sentence 1 35 of not more than two years and fine of $500 to $5,000). 2 1 Sexual exploitation is defined as engaging in conduct that 2 2 is for the purpose of arousing or satisfying the sexual 2 3 desires of the person in authority or the minor and includes 2 4 but is not limited to kissing; touching of the clothed or 2 5 unclothed inner thigh, breast, groin, buttock, anus, pubes, or 2 6 genitals; or committing a sex act as defined in Code section 2 7 702.17. 2 8 LSB 2398HV 78 2 9 jp/sc/14
