PAG LIN 1 1 HOUSE FILE 675 1 2 1 3 AN ACT 1 4 RELATING TO SCHOOL BREAKFAST PROGRAMMING. 1 5 1 6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 7 1 8 Section 1. Section 283A.2, subsection 2, as enacted by 1 9 1994 Iowa Acts, chapter 1193, section 24, is amended to read 1 10 as follows: 1 11 2. a.AllA schooldistrictsdistrict shall operate or 1 12 provide for the operation of school breakfast and lunch 1 13 programs at allpublic schoolsattendance centers ineachthe 1 14 district. However, with the approval of the department of 1 15 education as provided in paragraph "b", a school district may 1 16 provide access to a school breakfast program at an alternative 1 17 site to students who wish to participate in a school breakfast 1 18 program. The programs shall provide students with 1 19 nutritionally adequate meals and shall be operated in 1 20 compliance with the rules of the state board of education and 1 21 pertinent federal law and regulation, for all students in each 1 22 district who attend public school four or more hours each 1 23 school day and wish to participate in a school breakfast or 1 24 lunch program. School districts may provide school breakfast 1 25 and lunch programs for other students. 1 26 b. The board of directors of a school district that wishes 1 27 to provide safe, reasonable student access to a school 1 28 breakfast program, rather than operate or provide for the 1 29 operation of a school breakfast program at a specific 1 30 attendance center within the school district shall develop an 1 31 alternative site plan to operate the school breakfast program 1 32 at another attendance center within the school district and 1 33 shall annually certify to the department that the plan meets 1 34 the following criteria: 1 35 (1) Provides safe travel routes to and from the 2 1 alternative breakfast site for all eligible students. 2 2 (2) Minimizes student travel time between the student's 2 3 attendance center and the alternative breakfast site. 2 4 (3) Provides for a reasonable relationship between the 2 5 time breakfast is offered, the time the student is required to 2 6 arrive at the attendance center and alternative site, and the 2 7 daily school start time. 2 8 (4) Provides an alternative breakfast site facility 2 9 adequate for the number of students participating in the 2 10 breakfast program. 2 11 c. The board of directors of a school district that wishes 2 12 to provide access to a school breakfast program in accordance 2 13 with paragraph "b", shall notify the parent, guardian, or 2 14 legal or actual custodian of a child enrolled in the school 2 15 district of the school district's intention to develop and 2 16 implement a plan to provide school breakfast programs only in 2 17 certain attendance centers. At any time in which the school 2 18 district proposes to make substantive changes to a plan 2 19 certified with the department of education, the notification 2 20 requirements of this paragraph shall apply. 2 21 Sec. 2. Section 283A.2, subsection 3, Code 1999, is 2 22 amended to read as follows: 2 23 3. Effective July 1, 1999, all school districts shall 2 24 operate or provide for the operation of school breakfast 2 25 programs at all publicschoolsschool attendance centers in 2 26 each district or, if the school district meets the 2 27 requirements of paragraphs "b" and "c", shall provide access 2 28 to a school breakfast program at an alternative site to 2 29 students who wish to participate in a school breakfast 2 30 program. The programs shall provide students with 2 31 nutritionally adequate meals and shall be operated in 2 32 compliance with the rules of the state board of education and 2 33 pertinent federal law and regulation, for all students in each 2 34 district who attend public school and who wish to participate 2 35 in a school breakfast program. 3 1 a. A school or school district unable to meet the 3 2 requirement to provide a school breakfast program may, not 3 3 later than June 1, 1999, for the school year beginning July 1, 3 4 1999, file a written request to the department of education 3 5 that the department waive the requirement for that school or 3 6 school district. The written request shall include the reason 3 7 for which the waiver is being requested. The state board 3 8 shall evaluate the application for waiver, determine the 3 9 validity of the reason for which the waiver is being 3 10 requested, and grant or deny the application for waiver. The 3 11 state board shall establish criteria for determination of the 3 12 validity of reasons for waiver of the requirement that school 3 13 breakfast programs be operated at each school. However, the 3 14 state board shall not waive the school breakfast program 3 15 requirement for a school if thirty-five percent or more of the 3 16 students in attendance at the school during the month of March 3 17 1999 were eligible for free or reduced price meals under the 3 18 federal National School Lunch Act and the federal Child 3 19 Nutrition Act of 1966, 42 U.S.C. } 17511785. 3 20 b. The board of directors of a school district that wishes 3 21 to provide safe, reasonable student access to a school 3 22 breakfast program, rather than operate or provide for the 3 23 operation of a school breakfast program at a specific 3 24 attendance center within the school district shall develop an 3 25 alternative site plan to operate the school breakfast program 3 26 at another attendance center within the school district and 3 27 shall annually certify to the department that the plan meets 3 28 the following criteria: 3 29 (1) Provides safe travel routes to and from the 3 30 alternative breakfast site for all eligible students. 3 31 (2) Minimizes student travel time between the student's 3 32 attendance center and the alternative breakfast site. 3 33 (3) Provides for a reasonable relationship between the 3 34 time breakfast is offered, the time the student is required to 3 35 arrive at the attendance center and alternative site, and the 4 1 daily school start time. 4 2 (4) Provides an alternative breakfast site facility 4 3 adequate for the number of students participating in the 4 4 breakfast program. 4 5 c. The board of directors of a school district that wishes 4 6 to provide access to a school breakfast program in accordance 4 7 with paragraph "b", shall notify the parent, guardian, or 4 8 legal or actual custodian of a child enrolled in the district 4 9 of the school district's intention to develop and implement a 4 10 plan to provide school breakfast programs only in certain 4 11 attendance centers.
