PAG LIN 1 1 Section 1. Section 357B.8, subsection 2, Code 1999, is 1 2 amended to read as follows: 1 3 2. In lieu of subsection 1, a benefited fire district that 1 4 includes a city within the boundaries of the fire district may 1 5 certify an annual tax levy not exceedingfortysixty and one- 1 6 half cents per thousand dollars of assessed valuation of the 1 7 taxable property within the city for the purpose of fire 1 8 protection. The benefited fire district shall certify the tax 1 9 levy as provided in this subsection only after agreement 1 10 granted by resolution of the city council. The amount of the 1 11 tax rate levied under this subsection shall reduce by an equal 1 12 amount the maximum tax levy authorized for the general fund of 1 13 that city under section 384.1. If the district levies 1 14 directly against property within a city to provide fire 1 15 protection for that city, the city shall not be responsible 1 16 for providing fire protection as provided in section 364.16, 1 17 and shall have no liability for the method, manner, or means 1 18 in which the district provides the fire protection. 1 19 EXPLANATION 1 20 This bill increases the maximum tax levy authorized for a 1 21 benefited fire district which includes a city within its 1 22 boundaries from 40 and one-half cents per $1,000 of assessed 1 23 value of taxable property to 60 and one-half cents per $1,000 1 24 of assessed value of taxable property. 1 25 LSB 2655YH 78 1 26 tj/jw/5
