PAG LIN 1 1 DIVISION I 1 2 Section 1. ENFORCEMENT. There is appropriated from the 1 3 general fund of the state to the department of public safety, 1 4 for the fiscal year beginning July 1, 1999, and ending June 1 5 30, 2000, the following amounts, or so much thereof as is 1 6 necessary, to be used for the purposes designated: 1 7 1. For the division of narcotics enforcement: 1 8 For the employment of six narcotics enforcement agents, and 1 9 for not more than the following full-time equivalent 1 10 positions: 1 11 .................................................. $ 505,000 1 12 ............................................... FTEs 13.00 1 25 The clandestine methamphetamine laboratory emergency 1 26 response team established pursuant to this subsection shall 1 27 consist of five narcotics agents, one fire marshal special 1 28 agent, five state patrol officers, one division of criminal 1 29 investigation investigator, and one division of narcotics 1 30 enforcement technical support employee. 1 31 Sec. 2. YOUTH LEADERSHIP MODEL. There is appropriated 1 32 from the general fund of the state to the Iowa department of 1 33 corrections for the fiscal year beginning July 1, 1999, and 1 34 ending June 30, 2000, the following amount, or so much thereof 1 35 as is necessary, to be used for the purpose designated: 2 1 For the establishment of youth leadership model programs to 2 2 help at-risk youth in the judicial district departments of 2 3 correctional services selected by the department: 2 4 .................................................. $ 100,000 2 5 As a part of the program, the judicial district department 2 6 of correctional services may recruit high school athletes in 2 7 communities in the judicial district to work with at-risk 2 8 children. 2 9 Sec. 3. DRUG COURT PILOT PROGRAMS. The governor's 2 10 alliance on substance abuse shall subgrant on a reimbursement 2 11 basis from moneys received by the alliance under the federal 2 12 Edward Byrne memorial state and local law enforcement 2 13 assistance program to the judicial branch for the fiscal year 2 14 beginning July 1, 1999, and ending June 30, 2000, the 2 15 following amount, or so much thereof as is necessary, to be 2 16 used for the purpose designated: 2 17 For expenses associated with establishment of two drug 2 18 court pilot programs: 2 19 .................................................. $ 60,000 2 20 DIVISION II 2 21 Sec. 4. JUVENILE DELINQUENT TREATMENT. There is 2 22 appropriated from the general fund of the state to the 2 23 department of human services for the state training school at 2 24 Eldora, for the fiscal year beginning July 1, 1999, and ending 2 25 June 30, 2000, the following amount, or so much thereof as is 2 26 necessary, to be used for the purpose designated: 2 27 For providing treatment programs for every substance abuser 2 28 and sexual predator placed at the state training school 2 29 needing treatment: 2 30 .................................................. $ 62,000 2 31 Sec. 5. Section 217.12, subsection 3, paragraph b, Code 2 32 1999, is amended to read as follows: 2 33 b. Designation of the services to be provided for the 2 34 families served, including assistance regarding job-seeking 2 35 skills, family budgeting, nutrition, self-esteem, 3 1 methamphetamine education, health and hygiene, child rearing, 3 2 child education preparation, and goal setting. Grant 3 3 proposals shall indicate the support groups and support 3 4 systems to be developed for the families served during the 3 5 transition between the need for assistance and self- 3 6 sufficiency. 3 7 DIVISION III 3 8 Sec. 6. METHAMPHETAMINE TREATMENT. There is appropriated 3 9 from the general fund of the state to the Iowa department of 3 10 public health for the fiscal year beginning July 1, 1999, and 3 11 ending June 30, 2000, the following amounts, or so much 3 12 thereof as is necessary, to be used for the purposes 3 13 designated: 3 14 1. For additional methamphetamine treatment under the 3 15 substance abuse treatment program: 3 16 .................................................. $ 1,500,000 3 17 2. For development of a model substance abuse prevention 3 18 program based upon the North high school program in Des 3 19 Moines: 3 20 .................................................. $ 30,000 3 21 Information about the model substance abuse prevention 3 22 program developed under this subsection shall be distributed 3 23 to schools in this state that have a high percent of students 3 24 susceptible to substance abuse, particularly methamphetamine 3 25 abuse, to assist those schools that are submitting 3 26 applications for competitive grants from the department. 3 27 Sec. 7. YOUTH LEADERSHIP CONFERENCE ON MENTORING. There 3 28 is appropriated from the general fund of the state to the 3 29 governor's alliance on substance abuse for the fiscal year 3 30 beginning July 1, 1999, and ending June 30, 2000, the 3 31 following amount, or so much thereof as is necessary, to be 3 32 used for the purpose designated: 3 33 For planning and holding a youth leadership conference on 3 34 mentoring for individuals who agree to serve as mentors to 3 35 youth to help reduce substance abuse, especially 4 1 methamphetamine abuse, in schools: 4 2 .................................................. $ 20,000 4 3 Sec. 8. NEW SECTION. 135.16 SPECIAL WOMEN, INFANTS, AND 4 4 CHILDREN SUPPLEMENTAL FOOD PROGRAM FUNDING ALLOCATION. 4 5 As a component of the federal funding received by the 4 6 department as the administering agency for the special women, 4 7 infants, and children supplemental food program, from the 4 8 United States department of agriculture, food and consumer 4 9 service, the department shall incorporate a methamphetamine 4 10 education program into its nutrition and health-related 4 11 education services. The department shall be responsible for 4 12 the development of the education program to be delivered, and 4 13 for the selection of qualified contract agencies to deliver 4 14 the instruction under the program. 4 15 DIVISION IV 4 16 Sec. 9. LABOR MANAGEMENT SUBSTANCE ABUSE EDUCATION 4 17 PROGRAM. The executive council shall transfer from the health 4 18 insurance surplus account to the department of personnel for 4 19 the fiscal year beginning July 1, 1999, and ending June 30, 4 20 2000, the following amount, or so much thereof as is 4 21 necessary, which is appropriated to be used for the purpose 4 22 designated: 4 23 For development of a labor management substance abuse 4 24 education program, with an emphasis on methamphetamine abuse, 4 25 that can serve as a model to be used by labor and management 4 26 throughout the state: 4 27 .................................................. $ 30,000 4 28 DIVISION V 4 29 Sec. 10. STRENGTHENING FAMILIES PROGRAM. 4 30 1. The cooperative extension service at Iowa state 4 31 university, in association with the institute of social and 4 32 behavioral research at Iowa state university, shall develop a 4 33 strengthening families program to provide funding and 4 34 assistance to communities for families who have children 4 35 between the ages of 10 and 14 years of age for prevention of 5 1 substance abuse with an emphasis on prevention of 5 2 methamphetamine abuse. Communities participating in the 5 3 program must contract with the cooperative extension service 5 4 and provide a match for the cooperative extension service to 5 5 bring the program to the community. 5 6 2. The governor's alliance on substance abuse shall 5 7 subgrant on a reimbursement basis an amount not exceeding 5 8 $270,000 of moneys received by the alliance under the federal 5 9 Edward Byrne memorial state and local law enforcement 5 10 assistance program to support the strengthening families 5 11 program. A strengthening families program fund is established 5 12 in the office of the treasurer of state under the authority of 5 13 the department of education. The moneys shall be distributed 5 14 on a first-come, first-served matching funds basis by the 5 15 department of education to communities participating in the 5 16 strengthening families program. 5 17 Notwithstanding section 8.33, moneys in the fund that 5 18 remain unencumbered or unobligated at the close of the fiscal 5 19 year shall not revert but shall remain available for 5 20 expenditure for the purposes designated until the close of the 5 21 succeeding fiscal year. 5 22 3. The cooperative extension service shall solicit the 5 23 assistance of the department of education, the Iowa department 5 24 of public health, and other public and private agencies 5 25 providing services to families in promoting the program. 5 26 4. There is appropriated from the general fund of the 5 27 state to the department of education for the fiscal year 5 28 beginning July 1, 1999, and ending June 30, 2000, the 5 29 following amount, or so much thereof as is necessary, to be 5 30 used for the purpose designated: 5 31 For communities to participate in the strengthening 5 32 families program: 5 33 .................................................. $ 50,000 5 34 Sec. 11. Section 279.51, subsection 1, paragraph d, Code 5 35 1999, is amended to read as follows: 6 1 d. For the fiscal year beginning July 1, 1996, and for 6 2 each fiscal year thereafter, three million five hundred 6 3 thousand dollars of the funds appropriated shall be allocated 6 4 as grants to school districts that have elementary schools 6 5 that demonstrate the greatest need for programs for at-risk 6 6 students with preference given to innovative programs for the 6 7 early elementary school years. School districts receiving 6 8 grants under this paragraph shall at a minimum provide 6 9 activities and materials designed to encourage children's 6 10 self-esteem, provide role modeling and mentoring techniques in 6 11 social competence and social skills, and discourage 6 12 inappropriate drug use. The grant allocations made in this 6 13 paragraph may be renewed for additional periods of time. Of 6 14 the amount allocated under this paragraph for each fiscal 6 15 year, seventy-five thousand dollars shall be allocated to 6 16 school districts which have an actual student population of 6 17 ten thousand or less and have an actual non-English speaking 6 18 student population which represents greater than five percent 6 19 of the total actual student population for grants to 6 20 elementary schools in those districts. 6 21 Sec. 12. Section 279.51, subsection 3, unnumbered 6 22 paragraph 3, Code 1999, is amended to read as follows: 6 23 Programs shall provide at a minimum recreation 6 24 opportunities,; personal skills development,; activities and 6 25 materials designed to encourage children's self-esteem, 6 26 provide role modeling and mentoring techniques in social 6 27 competence and social skills, and discourage inappropriate 6 28 drug use; basic academic skills development,; family 6 29 interaction opportunities,; and mentoring. Additional 6 30 objectives of the programs shall be: to increase the ability 6 31 of existing agencies within the community to address the 6 32 multiple problems of children and youth and to coordinate 6 33 their activities and to facilitate joint planning to make the 6 34 most economic and innovative use of community resources. 6 35 Priority shall be given to programs that provide access to a 7 1 center for children and youth after school, in the evening, 7 2 and on weekends, and during the summer and that provide a 7 3 twenty-four-hour telephone hotline or similar service, and 7 4 that provide access to day care or on-site child day care. 7 5 Programs shall at a minimum provide career development 7 6 services, mental health and family counseling services, and 7 7 primary health care services that include but are not limited 7 8 to physical examinations, immunizations, hearing and vision 7 9 screening, and preventive and primary health care services, in 7 10 the context of the educational needs of the students. 7 11 Programs shall not include abortion counseling or the 7 12 dispensing of contraceptives. 7 13 EXPLANATION 7 14 This bill provides funding and establishes programs for 7 15 enforcement, prevention, education, and treatment for 7 16 substance abuse, especially methamphetamine abuse and sexual 7 17 abuse, and for programs for at-risk youth. 7 18 This bill appropriates moneys to the department of public 7 19 safety for the division of narcotics enforcement for the 7 20 purpose of employing six narcotics enforcement agents, and for 7 21 the division of criminal investigation for two criminalists 7 22 within the division of criminal investigation of the 7 23 department of public safety to focus on methamphetamine 7 24 testing. 7 25 The bill appropriates moneys to the department of public 7 26 safety for the establishment of a clandestine methamphetamine 7 27 laboratory emergency response team and specifies the members 7 28 of the response team. 7 29 The bill appropriates moneys to the department of 7 30 corrections for establishing a youth leadership model program 7 31 to help at-risk youth in a judicial district. 7 32 Federal moneys are transferred to the judicial branch for 7 33 establishing two pilot program drug courts. 7 34 The bill appropriates moneys to the department of human 7 35 services for the state training school at Eldora for treatment 8 1 for substance abusers and sexual predators. 8 2 The bill appropriates moneys to the Iowa department of 8 3 public health for additional methamphetamine treatment and for 8 4 development of a model substance abuse prevention program 8 5 based upon the North high school program. 8 6 The bill appropriates moneys to the governor's alliance on 8 7 substance abuse for a youth leadership conference on 8 8 mentoring. 8 9 The bill transfers moneys from the health insurance surplus 8 10 account to the department of personnel for development of a 8 11 labor-management substance abuse education program, with an 8 12 emphasis on methamphetamine abuse. 8 13 The bill directs the cooperative extension service, in 8 14 association with the institute for social and behavioral 8 15 research, to develop a strengthening families program to 8 16 assist communities providing programs for families with 8 17 children between 10 and 14 years of age for prevention of 8 18 substance abuse, especially methamphetamine abuse. The 8 19 program shall be funded through the department of education 8 20 using federal moneys and state moneys appropriated for use by 8 21 communities. In addition, a strengthening families program 8 22 fund is established under the authority of the department of 8 23 education. 8 24 The bill amends several Code provisions to require that the 8 25 Iowa department of public health include a methamphetamine 8 26 education program component in the nutrition and health- 8 27 related education services it administers under the federal 8 28 special supplemental food program for women, infants, and 8 29 children; that grant proposals submitted to the family 8 30 development and self-sufficiency council by public or private 8 31 organizations for provision of family development services to 8 32 families at risk of long-term welfare dependency must include 8 33 methamphetamine education as part of the services; and that 8 34 school districts which receive school-based youth services 8 35 grants or grants for elementary schools demonstrating the 9 1 greatest need for at-risk programs must provide activities and 9 2 materials designed to encourage children's self-esteem, 9 3 provide role modeling and mentoring techniques in social 9 4 competence and social skills, and discourage inappropriate 9 5 drug use. 9 6 LSB 3067HV 78 9 7 ec/jw/5
