  1  1    Section 1.  DEPARTMENT OF EDUCATION.  There is appropriated
  1  2 from the general fund of the state to the department of
  1  3 education for the fiscal year beginning July 1, 1999, and
  1  4 ending June 30, 2000, the following amounts, or so much
  1  5 thereof as is necessary, to be used for the purposes
  1  6 designated:
  1  7    1.  For extended school year grants as provided in section
  1  8 256.22:  
  1  9 .................................................. $  1,000,000
  1 10    2.  For innovative educational program grants as provided
  1 11 in section 256.22A:  
  1 12 .................................................. $    500,000
  1 13    Sec. 2.  Section 256.22, subsections 2 and 3, Code 1999,
  1 14 are amended to read as follows:
  1 15    2.  Grant moneys shall be distributed to qualifying school
  1 16 districts by the department no later than on or about October
  1 17 15, 1998 of the fiscal year in which the appropriation is
  1 18 made.  Grant amounts shall be distributed as determined by the
  1 19 department.
  1 20    3.  By February 15, 1999, a school district or
  1 21 collaboration of districts receiving moneys under this section
  1 22 shall submit an interim report to the department describing
  1 23 the planning activities conducted by the school district or
  1 24 the collaboration and providing preliminary conclusions.  The
  1 25 school district or collaboration shall submit a final report
  1 26 by June 1, 1999, to the department.  The department shall
  1 27 summarize the school district reports in a final report to the
  1 28 chairpersons and ranking members of the house and senate
  1 29 standing education committees by January 1, 2000 of the
  1 30 following fiscal year.
  1 31    Sec. 3.  NEW SECTION.  256.22A  INNOVATIVE EDUCATIONAL
  1 32 PROGRAM GRANTS.
  1 33    1.  The department of education shall administer and
  1 34 approve grants to school districts for new, innovative
  1 35 educational programs, with the funds appropriated by the
  2  1 general assembly for purposes of innovative educational
  2  2 program grants.  Grant moneys shall be allocated on a
  2  3 competitive basis to school districts that submit to the
  2  4 department a plan for a new, innovative educational program.
  2  5 Grants shall be equitably distributed to large, medium-sized,
  2  6 and small school districts.  For purposes of this section, a
  2  7 large school district is a district with an actual enrollment
  2  8 of five thousand or more pupils; a medium-sized school
  2  9 district is a district with an actual enrollment of two
  2 10 thousand or more pupils, but less than five thousand pupils;
  2 11 and a small school district is a district with an actual
  2 12 enrollment of less than two thousand pupils.
  2 13    2.  Grant moneys shall be distributed to qualifying school
  2 14 districts by the department on or about October 15 of the
  2 15 fiscal year in which the appropriation is made.  Grant amounts
  2 16 shall be distributed as determined by the department.
  2 17    3.  A school district receiving moneys under this section
  2 18 shall submit with the report to the department required under
  2 19 section 256.7, subsection 21, paragraph "c", a report
  2 20 describing the impact the new, innovative educational program
  2 21 funded under this section had on the school district's
  2 22 progress in attaining student achievement goals on the
  2 23 academic and other core indicators and on districtwide
  2 24 progress made in attaining locally established student
  2 25 learning goals.  The department shall summarize annually the
  2 26 school district reports and submit the summary and any
  2 27 recommendations regarding the grants and programs to the
  2 28 chairpersons and ranking members of the house and senate
  2 29 standing education committees by January 1 of the school year
  2 30 succeeding the fiscal year in which the appropriation is made.
  2 31    4.  Notwithstanding section 8.33, unencumbered or
  2 32 unobligated funds remaining on June 30 of the fiscal year for
  2 33 which the funds were appropriated shall not revert but shall
  2 34 be available for expenditure for the following fiscal year for
  2 35 purposes of this section.
  3  1    Sec. 4.  FISCAL YEAR 1999-2000 EXTENDED SCHOOL YEAR GRANT
  3  2 MONEYS.  Notwithstanding section 8.33 and section 256.22,
  3  3 subsection 4, the funds appropriated in 1998 Iowa Acts,
  3  4 chapter 1216, section 1, subsection 1, to the department of
  3  5 education for extended school year grants, which remain
  3  6 unencumbered or unobligated on June 30, 1999, shall not revert
  3  7 to the general fund of the state or be available for
  3  8 expenditure for the following fiscal year for purposes of
  3  9 extended school year grants, but shall be available for
  3 10 expenditure for the following fiscal year for purposes of the
  3 11 innovative educational program as established in section
  3 12 256.22A, if enacted.
  3 13    Sec. 5.  EMERGENCY RULES.  The department of education may
  3 14 adopt emergency rules under section 17A.4, subsection 2, and
  3 15 section 17A.5, subsection 2, paragraph "b", to implement the
  3 16 provisions of this Act and the rules shall be effective
  3 17 immediately upon filing unless a later date is specified in
  3 18 the rules.  Any rules adopted in accordance with this section
  3 19 shall also be published as a notice of intended action as
  3 20 provided in section 17A.4.  
  3 21                           EXPLANATION
  3 22    This bill appropriates $1 million for FY 1999-2000 from the
  3 23 general fund of the state to the department of education for
  3 24 extended school year planning and implementation grants.  Also
  3 25 for fiscal year 1999-2000, the bill appropriates $500,000 from
  3 26 the general fund of the state to the department to fund
  3 27 innovative educational program grants, which are provided for
  3 28 in the bill.
  3 29    The department of education is directed to administer and
  3 30 approve grants on a competitive basis to school districts for
  3 31 new, innovative educational programs.  To qualify for grant
  3 32 moneys, school districts must submit to the department a plan
  3 33 for a new, innovative education program.  Grants are to be
  3 34 equitably distributed to large, medium-sized, and small school
  3 35 districts.
  4  1    School districts that receive grants are required to
  4  2 submit, with their annual student achievement report to the
  4  3 department, a report describing the impact the new, innovative
  4  4 educational program had on the school district's progress in
  4  5 attaining student achievement goals on academic and other core
  4  6 indicators and on districtwide progress made in attaining
  4  7 locally established student learning goals.
  4  8    The department must summarize annually the school district
  4  9 reports and submit the summary and any recommendations
  4 10 regarding the grants and programs to the chairpersons and
  4 11 ranking members of the house and senate standing education
  4 12 committees.  The bill strikes 1998 and 1999 payment and
  4 13 reporting deadlines, and requires that the payments be made on
  4 14 dates tied to the fiscal year in which the appropriation is
  4 15 made.
  4 16    Moneys appropriated for grants that remain unencumbered or
  4 17 unobligated on June 30 of the fiscal year for which the funds
  4 18 were appropriated shall not revert but shall be available for
  4 19 grants in the following fiscal year.
  4 20    The bill captures funds that would have carried over at the
  4 21 end of FY 1998-1999 for extended school year grants in fiscal
  4 22 year 1999-2000, and requires that they be used for innovative
  4 23 educational program grants in FY 1999-2000.
  4 24    The bill gives the department of education emergency
  4 25 rulemaking authority to implement the provisions of this bill.
