PAG LIN 1 1 Section 1. Section 139B.1, subsection 1, paragraph a, Code 1 2 1999, is amended to read as follows: 1 3 a. "Contagious or infectious disease" means hepatitis in 1 4 any form, meningococcal disease, tuberculosis, blood-borne 1 5 diseases including AIDS or HIV infection as defined in section 1 6 141.21 and any other diseasewith the exception of AIDS or HIV1 7infection as defined in section 141.21,determined to be life- 1 8 threatening to a person exposed to the disease as established 1 9 by rules adopted by the department based upon a determination 1 10 by the state epidemiologist and in accordance with guidelines 1 11 of the centers for disease control of the United States 1 12 department of health and human services. 1 13 Sec. 2. Section 139B.1, subsection 2, paragraphs b, c, and 1 14 d, Code 1999, are amended to read as follows: 1 15 b. If an individual is diagnosed or confirmed as having a 1 16 contagious or infectious disease, the hospital shall 1 17 immediately notify the designated officer of an emergency care 1 18 provider service who shall immediately notify, in a 1 19 confidential manner, persons involved in attending or 1 20 transporting the individual.For blood-borne contagious or1 21infectious diseases, notification shall only take place upon1 22filing of an exposure report form with the hospital. The1 23exposure report form may be incorporated into the Iowa1 24prehospital care report, the Iowa prehospital advanced care1 25report, or a similar report used by an ambulance, rescue, or1 26first response service or law enforcement agency.1 27 c. A person who renders direct emergency aid without 1 28 compensation and is exposed to an individual who has a 1 29 contagious or infectious disease shall also receive 1 30 notification from the hospitalupon the filing with the1 31hospital of an exposure report form developed by the1 32department. 1 33 d. The notification shall advise the emergency care 1 34 provider of possible exposure to a particular contagious or 1 35 infectious disease and recommend that the provider seek 2 1 medical attention.The notification shall be provided as soon2 2as is reasonably possible following determination that the2 3individual has a contagious or infectious disease.2 4 Sec. 3. Section 141.22, subsection 5, paragraph d, 2 5 unnumbered paragraph 1, Code 1999, is amended to read as 2 6 follows: 2 7 The performance by a health care provider or health 2 8 facility of an HIV-related test when the subject of the test 2 9 is deceased,a significantan exposure as defined pursuant to 2 10 section141.22A139B.1 has occurred, and written consent is 2 11 obtained from any of the following persons, in order of 2 12 priority stated, if persons in prior classes are not 2 13 available: 2 14 Sec. 4. Section 141.22A, Code 1999, is repealed. 2 15 EXPLANATION 2 16 This bill eliminates the separate emergency care provider 2 17 notification procedures for HIV and AIDS and other contagious 2 18 or infectious diseases, and combines them under the current 2 19 chapter relating to contagious or infectious diseases. The 2 20 bill also makes conforming changes to reflect the elimination 2 21 of the separate procedure. 2 22 LSB 1777HH 78 2 23 pf/gg/8.1
