1 1 Section 1. Section 321.34, Code 1999, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 15. LEGION OF MERIT SPECIAL PLATES. The
1 4 owner of a motor vehicle subject to registration under section
1 5 321.109, subsection 1, light delivery truck, panel delivery
1 6 truck, or pickup who has been awarded the legion of merit may,
1 7 upon written application to the department and presentation of
1 8 satisfactory proof of the award of the legion of merit as
1 9 established by the Congress of the United States, order
1 10 special registration plates with a legion of merit processed
1 11 emblem. The emblem shall be designed by the department in
1 12 cooperation with the adjutant general and shall signify that
1 13 the owner was awarded the legion of merit. The application is
1 14 subject to approval by the department, in consultation with
1 15 the adjutant general. The special plates shall be issued at
1 16 no charge and are subject to an annual registration fee of
1 17 fifteen dollars. The county treasurer shall validate the
1 18 special plates in the same manner as regular registration
1 19 plates are validated under this section.
1 20 The surviving spouse of a person who was issued special
1 21 plates under this subsection may continue to use or apply for
1 22 and use the special plates subject to registration of the
1 23 special plates in the surviving spouse's name and upon payment
1 24 of the annual registration fee. If the surviving spouse
1 25 remarries, the surviving spouse shall return the special
1 26 plates to the department and the department shall issue
1 27 regular registration plates to the surviving spouse.
1 28 EXPLANATION
1 29 This bill authorizes the state department of transportation
1 30 to issue legion of merit special registration plates to
1 31 persons who have been awarded the legion of merit award as
1 32 established by the United States Congress. The plates shall
1 33 display a legion of merit processed emblem, designed by the
1 34 department in cooperation with the adjutant general, and shall
1 35 be issued at no charge, subject to an annual $15 registration
2 1 fee. The surviving spouse of a person who was issued the
2 2 special plates may continue to use or apply for and use the
2 3 special plates, unless the spouse has remarried. The
2 4 surviving spouse must register the plates in the surviving
2 5 spouse's name and pay the annual registration fee.
