1 1 Section 1. Section 172A.1, Code 1999, is amended by adding
1 2 the following new subsections:
1 3 NEW SUBSECTION. 2A. "Buyer" means a dealer or broker or
1 4 an agent.
1 5 NEW SUBSECTION. 2B. "Concentration point" means a
1 6 location or facility where livestock are assembled for
1 7 purchase by a dealer or broker for slaughtering, including but
1 8 not limited to a stockyard, auction market, or buying station.
1 9 Sec. 2. Section 172A.9, Code 1999, is amended by adding
1 10 the following new subsection:
1 11 NEW SUBSECTION. 1A. If a buyer purchasing swine at a
1 12 concentration point for slaughter promises to pay a price for
1 13 the swine based on attributes or characteristics of the swine
1 14 to be determined at a future time, the buyer shall maintain
1 15 records that match the swine to the seller of that swine. The
1 16 buyer shall place information identifying the seller on each
1 17 swine sold. The information may be in the form of a symbol or
1 18 color. The information may appear as a tag, stain, or mark
1 19 other than a brand as provided in chapter 169A. The
1 20 information shall not be removed or obscured by any person
1 21 until the seller accepts payment or the animal is slaughtered,
1 22 whichever occurs first.
1 23 EXPLANATION
1 24 This bill amends Code chapter 172A, which regulates
1 25 livestock packers referred to as dealers or brokers and their
1 26 agents. This bill refers to these persons as "buyers".
1 27 The bill provides that when a buyer purchases swine at a
1 28 concentration point such as buying station, and promises to
1 29 pay a price for the swine based on attributes or
1 30 characteristics of the swine to be determined at a future
1 31 time, the buyer must maintain records which match the swine to
1 32 the seller.
1 33 The bill requires the buyer to place information
1 34 identifying the seller on each swine sold. The bill provides
1 35 that the information may appear as a tag, stain, or mark other
2 1 than a brand. The bill provides that information cannot be
2 2 removed or obscured until the seller accepts payment or the
2 3 animal is slaughtered, whichever occurs earlier.
2 4 Code section 172A.10 provides that a person convicted of
2 5 violating any provision of chapter 172A is guilty of a serious
2 6 misdemeanor.
