PAG LIN 1 1 Section 1. Section 103A.7, subsection 5, Code 1999, is 1 2 amended to read as follows: 1 3 5. The accessibility and use by persons with disabilities 1 4 and elderly persons, of buildings, structures and facilities 1 5 which are constructed and intended for use by the general 1 6 public. The rules shall be consistent with federal standards 1 7 for building accessibility and shall only apply to those 1 8 buildings, structures, and facilities subject to chapter 104A. 1 9 Sec. 2. Section 104A.2, Code 1999, is amended to read as 1 10 follows: 1 11 104A.2 APPLICABILITY REQUIREMENTS. 1 12 The standards and specifications adopted by the state 1 13 building code commissioner and as set forth in this chapter 1 14 shall apply to all public and private buildings and 1 15 facilities, temporary and permanent, used by the general 1 16 public. The specific occupancies and minimum extent of 1 17 accessibility shall be in accordance with the conforming 1 18 standards set forth in section 104A.6. In every covered 1 19 multiple-dwelling-unit building containing four or more 1 20 individual dwelling units the requirements of this chapter and 1 21 those adopted by the state building code commissioner shall be 1 22 met. However, this chapter shall not apply to an elevator 1 23 located in a church or place of worship that is operated by a 1 24 religious organization. 1 25 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 1 26 immediate importance, takes effect upon enactment. 1 27 EXPLANATION 1 28 This bill provides that an elevator located in a church or 1 29 place of worship that is operated by a religious organization 1 30 shall not be subject to the provisions of the state building 1 31 code concerning accessibility of persons with disabilities. 1 32 This bill takes effect upon enactment. 1 33 LSB 2105HH 78 1 34 ec/cf/24
