1 1 Section 1. NEW SECTION. 514C.14 SUBSTANCE ABUSE
1 2 TREATMENT COVERAGE – COMMISSIONER DETERMINATION.
1 3 Notwithstanding section 514C.6, upon the determination of
1 4 the commissioner pursuant to section 513B.37, subsection 1,
1 5 paragraph "a", to include substance abuse treatment coverage
1 6 in basic benefit coverage policies or subscription contracts
1 7 under chapter 513B, the commissioner shall adopt by rule, with
1 8 all due diligence, requirements for the provision of coverage
1 9 for benefits for treatment services related to substance abuse
1 10 which shall be on the same terms as provided for other health
1 11 conditions. Rules adopted by the commissioner pursuant to
1 12 this section shall apply to all of the following:
1 13 1. Individual or group accident and sickness insurance
1 14 providing coverage on an expense-incurred basis.
1 15 2. An individual or group hospital or medical service
1 16 contract issued pursuant to chapter 509, 514, or 514A.
1 17 3. An individual or group health maintenance organization
1 18 contract regulated under chapter 514B.
1 19 4. An individual or group Medicare supplemental policy,
1 20 unless coverage pursuant to such policy is preempted by
1 21 federal law.
1 22 5. Any other entity engaged in the business of insurance,
1 23 risk transfer, or risk retention, which is subject to the
1 24 jurisdiction of the commissioner.
1 25 6. An organized delivery system licensed by the director
1 26 of public health.
1 27 EXPLANATION
1 28 This bill directs the commissioner to adopt by rule,
1 29 requirements for the provision of coverage for benefits for
1 30 treatment services related to substance abuse which shall be
1 31 on the same terms as provided for other health conditions upon
1 32 a finding by the commissioner pursuant to Code section 513B.37
1 33 to include substance abuse treatment coverage in small group
1 34 basic benefit coverage policies or subscription contracts
1 35 subject to Code chapter 513B.
