1 1 Section 1. Section 124.401, subsection 5, Code 1999, is
1 2 amended by adding the following new unnumbered paragraph
1 3 before unnumbered paragraph 3:
1 4 NEW UNNUMBERED PARAGRAPH. If a violation of this
1 5 subsection involves possession of methamphetamine, its salts,
1 6 isomers, or salts of its isomers, the person commits a class
1 7 "D" felony for a first, second, or subsequent offense.
1 8 EXPLANATION
1 9 This bill changes the penalty applicable to a first-time or
1 10 second-time offender convicted of possession of
1 11 methamphetamine from a serious or aggravated misdemeanor to a
1 12 class "D" felony.
1 13 A serious misdemeanor is punishable by confinement for no
1 14 more than one year and a fine of at least $250 but not more
1 15 than $1,500. An aggravated misdemeanor is punishable by
1 16 confinement for no more than two years and a fine of at least
1 17 $500 but not more than $7,500.
1 18 A class "D" felony is punishable by confinement for no more
1 19 than five years and a fine of at least $500 but not more than
1 20 $7,500.
