  1  1    Section 1.  Section 598.1, subsection 8, Code 1999, is
  1  2 amended to read as follows:
  1  3    8.  "Postsecondary education subsidy" means an amount which
  1  4 either of the parties may be required to pay under a temporary
  1  5 order or final judgment or decree for educational expenses of
  1  6 a child who is between any of the following:
  1  7    a.  Between the ages of eighteen and twenty-two years if
  1  8 the child is regularly attending a course of vocational-
  1  9 technical training either as a part of a regular school
  1 10 program or under special arrangements adapted to the
  1 11 individual person's needs; or is, in good faith, a full-time
  1 12 student in a college, university, or community college; or has
  1 13 been accepted for admission to a college, university, or
  1 14 community college and the next regular term has not yet begun.
  1 15    b.  Any age if the child has a learning disability or a
  1 16 physical or mental disability.
  1 17    Sec. 2.  Section 598.21, subsection 5A, paragraph d, Code
  1 18 1999, is amended to read as follows:
  1 19    d.  The child shall forward, to each parent, reports of
  1 20 grades awarded at the completion of each academic session,
  1 21 within ten days of receipt of the reports.  Unless otherwise
  1 22 specified by the parties or unless the child has a learning
  1 23 disability or a physical or mental disability, a postsecondary
  1 24 education subsidy awarded by the court shall be terminated
  1 25 upon the child's completion of the first calendar year of
  1 26 course instruction if the child fails to maintain a cumulative
  1 27 grade point average in the median range or above during that
  1 28 first calendar year.  
  1 29                           EXPLANATION
  1 30    This bill includes in the definition of a child who may
  1 31 receive a postsecondary education subsidy, a child of any age
  1 32 who has a learning disability or a physical or mental
  1 33 disability.
  1 34    The bill also makes an exception for a child who has such a
  1 35 disability to the requirement that a child must maintain a
  2  1 grade point average in the median range or above during the
  2  2 first calendar year of postsecondary study to continue to
  2  3 receive the postsecondary education subsidy.
