1 1 Section 1. NEW SECTION. 70A.40 STATE COMPUTER USE –
1 2 NONOFFICIAL PROGRAMS PROHIBITED.
1 3 1. As used in this section, unless the context otherwise
1 4 requires:
1 5 a. "Access", "computer", "data", and "data processing
1 6 software" mean the same as defined in section 22.3A.
1 7 b. "Program" means ordered instructions or statements,
1 8 languages, or procedures, including data processing software,
1 9 that are electronic or magnetic impulses read or processed by
1 10 a computer for purposes of performing the high-speed execution
1 11 of human commands, including but not limited to the entry or
1 12 manipulation of data.
1 13 2. A person who is a state officer or employee shall not
1 14 access a computer in order to use a program or deliver or
1 15 receive data processed by a computer, if both of the following
1 16 apply:
1 17 a. The computer is property of the state, including owned,
1 18 rented, or leased by the state.
1 19 b. The program or data is unrelated to the duties or
1 20 employment of the person or another state officer or employee
1 21 with whom the person has an employment relationship, including
1 22 but not limited to programs designed solely for the purpose of
1 23 entertainment, competition, or amusement.
1 24 EXPLANATION
1 25 This bill prohibits a person who is a state officer or
1 26 employee from accessing a state computer in order to use a
1 27 computer program or deliver or receive computer data, if the
1 28 program or data is unrelated to the duties or employment of
1 29 the person or another state officer or employee with whom the
1 30 person has an employment relationship. The bill expressly
1 31 prohibits a person from using a computer program designed
1 32 solely for the purpose of entertainment, competition, or
1 33 amusement.
