  1  1    Section 1.  Section 461A.35, Code 1999, is amended to read
  1  2 as follows:
  1  3    461A.35  PROHIBITED DESTRUCTIVE ACTS.
  1  4    It shall be is unlawful for any person to use, enjoy the
  1  5 privileges of, destroy, injure, or deface plant life, trees,
  1  6 buildings, or other natural or material property, or to
  1  7 construct or operate for private or commercial purposes any
  1  8 structure, or to remove any plant life, trees, buildings,
  1  9 sand, gravel, ice, earth, stone, wood, or other natural
  1 10 material, or to operate vehicles, within the boundaries of any
  1 11 state park, preserve, or stream, or any other lands or waters
  1 12 under the jurisdiction of the commission for any purpose
  1 13 whatsoever, except upon the terms, conditions, limitations,
  1 14 and restrictions as set forth by the commission.  The
  1 15 commission shall prohibit the harvest of timber for commercial
  1 16 purposes in state parks.  
  1 17                           EXPLANATION
  1 18    This bill provides that the natural resource commission of
  1 19 the department of natural resources shall prohibit the
  1 20 commercial harvest of timber in state parks.  A person
  1 21 violating this prohibition commits a simple misdemeanor as
  1 22 provided in Code section 461A.57.  A person convicted of the
  1 23 offense may be sentenced to a penalty of a maximum of 30 days
  1 24 imprisonment or a fine of at least $50 but not more than $100.
