  1  1    Section 1.  Section 483A.7, subsection 3, Code 1999, is
  1  2 amended to read as follows:
  1  3    3.  A nonresident wild turkey hunter is required to have
  1  4 only a nonresident wild turkey hunting license and pay the
  1  5 wildlife habitat fee.  The commission shall annually limit to
  1  6 two thousand licenses the number of nonresidents allowed to
  1  7 have wild turkey hunting licenses.  However, a wild turkey
  1  8 hunting license issued to a nonresident who owns a farm unit
  1  9 shall not be included in the annual wild turkey license
  1 10 limitation.  The number of nonresident wild turkey hunting
  1 11 licenses shall be determined as provided in section 481A.38.
  1 12 The commission shall allocate the nonresident wild turkey
  1 13 hunting licenses issued among the zones based on the
  1 14 populations of wild turkey.  A nonresident applying for a wild
  1 15 turkey hunting license must exhibit proof of having
  1 16 successfully completed a hunter safety and ethics education
  1 17 program as provided in section 483A.27 or its equivalent as
  1 18 determined by the department before the license is issued.
  1 19    Sec. 2.  Section 483A.7, Code 1999, is amended by adding
  1 20 the following new subsection:
  1 21    NEW SUBSECTION.  4.  As used in this section, "farm unit"
  1 22 means all parcels of land, not necessarily contiguous, which
  1 23 are operated as a unit for agricultural purposes and which are
  1 24 under the control of the nonresident owner.
  1 25    Sec. 3.  Section 483A.8, subsection 3, Code 1999, is
  1 26 amended to read as follows:
  1 27    3.  A nonresident hunting deer is required to have a
  1 28 nonresident deer license and must pay the wildlife habitat
  1 29 fee.  The commission shall annually limit to seven thousand
  1 30 five hundred licenses the number of nonresidents allowed to
  1 31 have deer hunting licenses.  Of the first six thousand
  1 32 nonresident deer licenses issued, not more than thirty-five
  1 33 percent of the licenses shall be bow season licenses and,
  1 34 after the first six thousand nonresident deer licenses have
  1 35 been issued, all additional licenses shall be issued for
  2  1 anterless deer only.  However, a deer hunting license issued
  2  2 to a nonresident who owns a farm unit shall not be included in
  2  3 the annual deer license limitations.  The number of
  2  4 nonresident deer hunting licenses shall be determined as
  2  5 provided in section 481A.38.  The commission shall allocate
  2  6 the nonresident deer hunting licenses issued among the zones
  2  7 based on the populations of deer.  However, a nonresident
  2  8 applicant may request one or more hunting zones, in order of
  2  9 preference, in which the applicant wishes to hunt.  If the
  2 10 request cannot be fulfilled, the applicable fees shall be
  2 11 returned to the applicant.  A nonresident applying for a deer
  2 12 hunting license must exhibit proof of having successfully
  2 13 completed a hunter safety and ethics education program as
  2 14 provided in section 483A.27 or its equivalent as determined by
  2 15 the department before the license is issued.
  2 16    Sec. 4.  Section 483A.8, Code 1999, is amended by adding
  2 17 the following new subsection:

  2 22                           EXPLANATION
  2 23    This bill provides that deer and wild turkey hunting
  2 24 licenses issued to a nonresident hunter who owns a farm unit
  2 25 in this state shall not be included in the annual license
  2 26 limitations for nonresident deer and wild turkey licenses.
  2 27 Farm unit is defined to mean all parcels of land, not
  2 28 necessarily contiguous, which are operated as a unit for
  2 29 agricultural purposes and which are under the lawful control
  2 30 of the nonresident owner.  Currently, the department of
  2 31 natural resources shall not issue more than 2,000 wild turkey
  2 32 hunting licenses to nonresidents and not more than 7,500 deer
  2 33 hunting licenses to nonresidents.
