  1  1    Section 1.  There is appropriated from the general fund of
  1  2 the state to the department of education for the fiscal year
  1  3 beginning July 1, 1999, and ending June 30, 2000, the
  1  4 following amount, or so much thereof as is necessary, to be
  1  5 used for the purposes designated:
  1  6    For allocation to school districts for purposes of class
  1  7 size reduction, school discipline, and reading improvement:  
  1  8 .................................................. $15,000,000
  1  9    1.  From the moneys appropriated in this section, the
  1 10 amount of moneys allocated to school districts shall be in the
  1 11 proportion that the basic enrollment of a district bears to
  1 12 the sum of the basic enrollments of all school districts in
  1 13 the state for the budget year.  However, a district shall not
  1 14 receive less than fourteen thousand dollars in a fiscal year.
  1 15    2.  The department of education shall notify the department
  1 16 of revenue and finance of the amount of the allocation to be
  1 17 paid to each school district as provided in subsection 1.  The
  1 18 allocation to each school district shall be made in one
  1 19 payment on or about October of the fiscal year for which the
  1 20 appropriation is made, taking into consideration the relative
  1 21 budget and cash position of the state resources.
  1 22    3.  Moneys received under this section shall not be
  1 23 commingled with state aid payments made under section 257.16
  1 24 to a school district and shall be accounted for by the school
  1 25 district separately from state aid payments.
  1 26    4.  Payments made to school districts under this section
  1 27 are miscellaneous income for purposes of chapter 257 or are
  1 28 considered encumbered.  Each school district shall maintain a
  1 29 separate listing within its budget for payments received and
  1 30 expenditures made pursuant to this section.
  1 31    5.  Moneys received under this section shall be used to
  1 32 supplement, and not to supplant, moneys otherwise received and
  1 33 used by the school district for the purposes described in
  1 34 subsection 7.
  1 35    6.  Moneys received under this section shall not be used
  2  1 for payment of any collective bargaining agreement or
  2  2 arbitrator's decision negotiated or awarded under chapter 20.
  2  3    7.  Moneys received under this section shall only be
  2  4 expended to support reading instruction; reduce adult to
  2  5 student ratios through the hiring of teachers, former
  2  6 teachers, and para-educator teaching assistants; or implement
  2  7 programs designed to improve student behavior and classroom
  2  8 management.  
  2  9                           EXPLANATION
  2 10    This bill appropriates $15 million for fiscal year 1999-
  2 11 2000 from the general fund of the state to the department of
  2 12 education for allocation to school districts for purposes of
  2 13 class size reduction and improvements in student behavior,
  2 14 classroom management, and reading.
  2 15    Moneys will be distributed on a per pupil basis annually,
  2 16 however, the minimum amount a school district will receive is
  2 17 $14,000.  Districts can expend moneys received under the bill
  2 18 only to support reading instruction; reduce adult to student
  2 19 ratios through the hiring of teachers, former teachers, and
  2 20 para-educator teaching assistants; or implement programs
  2 21 designed to improve student behavior and classroom management.
