  1  1           HOUSE CONCURRENT RESOLUTION NO. ___
  1  2                       By  FALLON
  1  3 A House Concurrent Resolution relating to the use of
  1  4    the Iowa Air National Guard to patrol no-fly zones
  1  5    over Iraq.
  1  6    WHEREAS, the United States of America is a member
  1  7 nation of the United Nations; and
  1  8    WHEREAS, every United Nations member nation is
  1  9 bound by the United Nations Charter; and
  1 10    WHEREAS, Article 51 of the United Nations Charter
  1 11 prohibits the use of force against a sovereign nation,
  1 12 except in self-defense, without United Nations
  1 13 Security Council authorization; and
  1 14    WHEREAS, the establishment of no-fly zones by the
  1 15 United States and Great Britain within the borders of
  1 16 Iraq has never received United Nations Security
  1 17 Council approval, is not sanctioned by any United
  1 18 Nations resolution, lacks international support, and
  1 19 is not vital to the national security of the United
  1 20 States; and
  1 21    WHEREAS, France has withdrawn its participation in
  1 22 and support for enforcement of the no-fly zones over
  1 23 Iraq; and
  1 24    WHEREAS, United States and British missile attacks
  1 25 against Iraq have been condemned by religious leaders,
  1 26 including Pope John Paul II; and
  1 27    WHEREAS, since December 1998, United States and
  1 28 British warplanes, threatened by Iraqi anti-aircraft
  1 29 weapons while patrolling the no-fly zones, have
  1 30 carried out nearly daily missile attacks against Iraqi
  2  1 targets, as reported in the New York Times, resulting
  2  2 in more than 200 civilian casualties, destruction of
  2  3 schools, hospitals, and water supplies, according to
  2  4 the United Nations International Children's Emergency
  2  5 Fund, the United Nations Children's Fund, and the
  2  6 World Food Program; and
  2  7    WHEREAS, Iowa Air National Guard warplanes and
  2  8 personnel have been mobilized by the President of the
  2  9 United States and the United States Department of
  2 10 Defense to patrol the no-fly zones over Iraq; and
  2 11    WHEREAS, participation of Iowa Air National Guard
  2 12 personnel and warplanes in patrolling the no-fly zones
  2 13 over Iraq unnecessarily puts Iowans at risk of injury
  2 14 or death; and
  2 15    WHEREAS, participation of Iowa Air National Guard
  2 16 personnel and warplanes in patrolling the no-fly zones
  2 17 over Iraq is a violation of the United Nations
  2 18 Charter; NOW THEREFORE,
  2 19    BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
  2 20 SENATE CONCURRING, That the Iowa General Assembly
  2 21 publicly opposes the use of the Iowa Air National
  2 22 Guard to patrol the no-fly zones over the sovereign
  2 23 territory of Iraq, and calls on the President of the
  2 24 United States and the United States Secretary of
  2 25 Defense to discontinue use of the Iowa Air National
  2 26 Guard to patrol the no-fly zones over Iraq.
