1 1 HOUSE CONCURRENT RESOLUTION NO. ___
1 2 BY HUSER, GIPP, THOMAS, FALCK, SUNDERBRUCH,
1 3 TEIG, and JAGER
1 4 A Concurrent Resolution requesting establishment of
1 5 a legislative interim study committee to review the
1 6 authority and responsibilities of townships as a unit
1 7 of local government in this state.
1 8 WHEREAS, townships have existed in this state for
1 9 more than a century as an important unit of local
1 10 government; and
1 11 WHEREAS, townships hold important responsibilities
1 12 for financing and providing services to the citizens
1 13 of the township; and
1 14 WHEREAS, townships exercise powers of condemnation,
1 15 property taxation, appointment of ex officio police
1 16 officers, purchase and sale of land, and receipt and
1 17 expenditure of public and private moneys; and
1 18 WHEREAS, townships may establish fire protection
1 19 services, emergency warning systems, and emergency
1 20 medical services, and may levy property taxes and
1 21 issue anticipatory bonds to support these public
1 22 functions; and
1 23 WHEREAS, the authority and responsibilities of
1 24 townships relative to the authority and
1 25 responsibilities of cities, benefited districts, and
1 26 counties are not well understood by the public and
1 27 policymakers; NOW THEREFORE,
1 28 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
1 29 SENATE CONCURRING, That the Legislative Council is
1 30 requested to establish an interim study committee to
2 1 perform a review of the authority and responsibilities
2 2 of townships. If established, the study committee
2 3 should be directed to make a comprehensive study of
2 4 all aspects of townships, including but not limited to
2 5 budgeting practices, election requirements, taxation
2 6 practices, and the provision of fire protection
2 7 services and emergency medical services. The study
2 8 committee should also be directed to make findings and
2 9 recommendations for legislative changes, if determined
2 10 by the study committee to be necessary, to improve the
2 11 functioning of townships as viable units of local
2 12 government or to integrate township responsibilities
2 13 with those responsibilities of other units of local
2 14 government.
