1 2 #1. Page 155, by striking lines 14 though 28 and
1 3 inserting the following: "impact of such workforce
1 4 reduction on its employees. An electric utility shall
1 5 develop a workforce reduction plan not less than one
1 6 hundred twenty days in advance of any planned
1 7 workforce reduction which results from restructuring
1 8 of the electric utility industry during the period
1 9 between the effective date of this chapter and January
1 10 1, 2007. A workforce reduction plan shall include
1 11 lump sum severance provisions, lump sum early
1 12 retirement provisions, lump sum reimbursements for
1 13 medical insurance, and lump sum tuition reimbursements
1 14 which are equivalent to the prevailing industry
1 15 standard for workforce reduction plans at the time the
1 16 electric company announces a workforce reduction. If
1 17 the employees of an electric company are represented
1 18 by a labor organization, the collective bargaining
1 19 agreement shall remain in effect and the provisions of
1 20 this chapter shall not decrease or limit any benefit
1 21 set forth in such agreement. The electric utility and
1 22 the representatives of the affected workforce may
1 23 negotiate any changes and if an agreement is not
1 24 reached within sixty days, shall proceed to binding
1 25 arbitration. An arbitrator's award shall not decrease
1 26 or limit any benefit set forth in an existing
1 27 collective bargaining agreement. If such employees
1 28 are not represented by a labor organization and will
1 29 involuntarily lose employment, the electric utility
1 30 shall develop a workforce reduction plan in accordance
1 31 with the provisions of this subsection and to the
1 32 satisfaction of its board of directors, if an electric
1 33 company, or its governing body, if a consumer-owned
1 34 utility. Workforce reductions shall not occur unless
1 35 the electric utility complies with the above stated
1 36 provisions. For purposes of this section,".
