  1  1    Amend the amendment, H-8523, to House File 2530, as
  1  2 follows:
  1  3    #1.  Page 1, line 15, by inserting after the word
  1  4 "percent." the following:  "In any given year, these
  1  5 requirements shall be reduced by the percentage of
  1  6 total kilowatt-hours of retail sales in this state
  1  7 represented by renewable energy, the costs of which
  1  8 have been recovered through charges provided for under
  1  9 section 476B.15, subsection 3."
  1 10    #2.  Page 2, line 2, by inserting after the word
  1 11 "displacement." the following:  "To the extent not
  1 12 inconsistent with a renewable energy credit system
  1 13 established by federal law or rule, credits shall only
  1 14 be issued for renewable energy facilities constructed
  1 15 after January 1, 2000."

  1 29 surcharges to be charged under this subparagraph
  1 30 subdivision, shall determine the amounts of the
  1 31 monthly surcharges.  The monthly surcharges shall be
  1 32 designed to produce, in a manner that is fair and
  1 33 equitable to the affected end-use consumers, a total
  1 34 of seven million two hundred five thousand two hundred
  1 35 sixty-nine dollars annually from such accounts."

  2  4 surcharges to be assessed under this paragraph against
  2  5 nonresidential electric accounts with annual usage of
  2  6 more than six million kilowatt-hours, shall determine
  2  7 the amounts of the monthly surcharges to be assessed
  2  8 against new nonresidential electric accounts of end-
  2  9 use consumers with annual usage of more than six
  2 10 million kilowatt-hours that first receives electric
  2 11 service on or after October 1, 2002.  The monthly
  2 12 surcharges shall be designed to produce an amount that
  2 13 is fair and equitable to the affected end-use
  2 14 consumers and are applicable to the assigned service
  2 15 areas of electric companies and consumer-owned
  2 16 utilities.  A monthly surcharge collected from a new
  2 17 end-use consumer shall not exceed the monthly
  2 18 surcharge to be collected from a similar existing end-
  2 19 use consumer that is located in the assigned service
  2 20 area of a delivery service provider that is an
  2 21 electric company and was receiving electric service
  2 22 prior to October 1, 2002."

  3 14 applicable to the assigned service areas of electric
  3 15 companies and consumer-owned utilities.  A monthly
  3 16 surcharge collected from a new end-use consumer shall
  3 17 not exceed the monthly surcharge to be collected from
  3 18 a similar existing end-use consumer that is located in
  3 19 the assigned service area of a delivery service

  5  2 of the associations concerning whether the
  5  3 nonbypassable monthly surcharges assessed against end-
  5  4 use consumers as provided in section 476B.13,
  5  5 subsection 1, paragraph "f", subparagraph (3),
  5  6 subparagraph subdivision (g); section 476B.13,
  5  7 subsection 3, paragraph "a", subparagraph (3),
  5  8 subparagraph subdivision (g); and section 476B.13,
  5  9 subsection 4, paragraph "j", subparagraph (3),
  5 10 subparagraph subdivision (g); should remain the same
  5 11 or be adjusted.  If the associations recommend that
  5 12 such monthly surcharges be adjusted, such adjustments
  5 13 shall be designed to annually produce seven hundred
  5 14 twenty-eight thousand one hundred fifty-seven dollars
  5 15 under section 476B.13, subsection 1, paragraph "f",
  5 16 subparagraph (3), subparagraph subdivision (g); sixty-
  5 17 one thousand nine hundred seventy-one dollars under
  5 18 section 476B.13, subsection 3, paragraph "a",
  5 19 subparagraph (3), subparagraph subdivision (g); and
  5 20 eight hundred ninety-three thousand four hundred nine
  5 21 dollars under section 476B.13, subsection 4, paragraph
  5 22 "j", subparagraph (3), subparagraph subdivision (g).""
  5 23    #16.  By renumbering as necessary.
