  1  1    Amend House File 2530 as follows:
  1  2    #1.  Page 47, line 34, by inserting after the word
  1  3 "provisions." the following:  "The board shall adopt
  1  4 appropriate benchmarks regarding outage duration and
  1  5 delivery service restoration.  In adopting benchmarks,
  1  6 the board shall give due consideration to historical
  1  7 data and shall also address outages of extended
  1  8 duration."
  1  9    #2.  Page 48, line 12, by inserting after the word
  1 10 "and" the following:  "continual".
  1 11    #3.  Page 79, by inserting after line 25 the
  1 12 following:
  1 13    "(5)  Until January 1, 2006, any reduction of ten
  1 14 percent or more in employment levels of delivery
  1 15 service employees engaged in installing, operating, or
  1 16 maintaining delivery services and facilities that
  1 17 occurs within any twelve-month period, whether by
  1 18 means of layoff, termination, retirement, severance,
  1 19 or attrition."
  1 20    #4.  Page 118, line 27, by inserting after the word
  1 21 "detrimental" the following:  "or retaliatory".
  1 22    #5.  Page 118, line 29, by inserting after the word
  1 23 "board." the following:  "In addition to the remedies
  1 24 and penalties in section 476B.20, the board may order
  1 25 a delivery service provider that is an electric
  1 26 company to reinstate an employee affected by a
  1 27 violation of this subsection."
  1 28    #6.  Page 125, line 16, by inserting after the word
  1 29 "PROVIDERS." the following:  "a."
  1 30    #7.  Page 125, by inserting after line 31 the
  1 31 following:
  1 32    "b.  For the purpose of recovering start-up costs
  1 33 under this subsection, the following shall be presumed
  1 34 to be reasonable costs incurred pursuant to section
  1 35 476B.24:
  1 36    (1)  Lump sum tuition reimbursement at any college,
  1 37 vocational or technical school, or other similar
  1 38 program in this state attended by the employee within
  1 39 two years of the employee's severance, equivalent to
  1 40 one year's tuition or three thousand dollars,
  1 41 whichever is greater.
  1 42    (2)  Lump sum reimbursements of health or medical
  1 43 insurance coverage at existing coverage and
  1 44 contribution levels for the employee and eligible
  1 45 family members for a period of twenty-four months
  1 46 following the employee's severance or until the
  1 47 employee obtains health care coverage under another
  1 48 employee health care coverage plan, whichever period
  1 49 is shorter.
  1 50    (3)  The lump sum value of any early retirement
  2  1 program offered to those employees affected by loss of
  2  2 employment that includes supplemental payments of at
  2  3 least seven hundred twenty dollars per month and
  2  4 continued health care coverage at applicable rates in
  2  5 effect for active employees until age sixty-two.
  2  6    (4)  Lump sum severance payments based on years of
  2  7 service and rates of pay in effect on the date of
  2  8 separation for at least ten percent of the employee's
  2  9 base pay for employees with one through five years of
  2 10 service; fifty percent of base pay for employees with
  2 11 six through ten years of service; and seventy-five
  2 12 percent of base pay for employees with eleven or more
  2 13 years of service, but in no event less than two weeks
  2 14 of weekly base pay for each year of full-time
  2 15 employment."
  2 16    #8.  Page 125, line 32, by inserting before the
  2 17 words "An electric" the following:  "c."
  2 18    #9.  Page 156, by striking lines 34 and 35 and
  2 19 inserting the following:  "2006, that affiliate shall
  2 20 continue to employ the utility's nonsupervisory
  2 21 employees who were employed by the utility at such
  2 22 division, business unit, generating station, or
  2 23 generating unit at the time of the transfer under the
  2 24 same terms and conditions of employment as those
