1 25 5A. FUNDING NONBYPASSABLE SURCHARGE.
1 26 a. The programs established in this section shall
1 27 be funded by all end-use consumers through a
1 28 nonbypassable monthly surcharge on all distribution
1 29 services within a delivery service provider's assigned
1 30 service area, including service provided under rates
1 31 or charges pursuant to section 476B.8. The monthly
1 32 surcharge shall be collected by the person billing the
1 33 end-use consumer for the service. The monthly
1 34 surcharge shall commence with bills issued on October
1 35 1, 2002. The monthly surcharge for each customer
1 36 class shall be as follows:
1 37 (1) One dollar and fifty cents for a residential
1 38 electric account.
1 39 (2) One dollar and fifty cents for a
1 40 nonresidential electric account with an annual usage
1 41 of less than twenty-five thousand kilowatt-hours in
1 42 the prior calendar year.
1 43 (3) Ten dollars for a nonresidential electric
1 44 account with an annual usage of twenty-five thousand
1 45 kilowatt-hours to one hundred thousand kilowatt-hours
1 46 in the prior calendar year.
1 47 (4) Thirty-six dollars for a nonresidential
1 48 electric account with an annual usage of more than one
1 49 hundred thousand kilowatt-hours to four hundred
1 50 thousand kilowatt-hours in the prior calendar year.
2 1 (5) One hundred fifty dollars for a nonresidential
2 2 electric account with an annual usage of more than
2 3 four hundred thousand kilowatt-hours to one million
2 4 five hundred thousand kilowatt-hours in the prior
2 5 calendar year.
2 6 (6) Seven hundred fifty dollars for a
2 7 nonresidential electric account with an annual usage
2 8 of more than one million five hundred thousand
2 9 kilowatt-hours to six million kilowatt-hours in the
2 10 prior calendar year.
2 11 (7) Five thousand five hundred dollars for a
2 12 nonresidential electric account with an annual usage
2 13 of more than six million kilowatt-hours in the prior
2 14 calendar year.
2 15 b. For the purpose of determining the monthly
2 16 surcharge under paragraph "a", the term "accounts" may
2 17 be interpreted by the board in appropriate
2 18 circumstances to mean end-use consumers. After the
2 19 first twelve-month period that moneys are collected
2 20 pursuant to this subsection, the monthly surcharge
2 21 amounts shall be adjusted by the board as necessary to
2 22 yield no less than seventy-nine million dollars
2 23 annually and no more than eighty million dollars
2 24 annually. For a nonresidential consumer with no prior
2 25 calendar-year usage, the delivery service provider may
2 26 use a reasonable estimate of the consumer's usage.
2 27 The board, by rule, shall provide a schedule for
2 28 remittances. The initial rules shall be proposed by
2 29 December 1, 2001.
2 30 c. All moneys collected pursuant to this
2 31 subsection shall be remitted to the treasurer of the
2 32 state and deposited as follows:
2 33 (1) Twenty-three million five hundred thousand
2 34 dollars in a separate account to be used for the low-
2 35 income affordability program and a low-income energy
2 36 efficiency program as provided under subsection 1.
2 37 The treasurer shall make disbursements from this
2 38 account as appropriate. Notwithstanding section 8.33,
2 39 the unencumbered or unobligated moneys remaining at
2 40 the end of any fiscal year from the allocation made in
2 41 this subparagraph shall not revert but shall be
2 42 available for expenditure during subsequent fiscal
2 43 years until expended for the purposes for which
2 44 originally appropriated. Interest or earnings on
2 45 investments or time deposits of the moneys in the
2 46 account shall be retained for the purposes designated
2 47 under subsection 1.
2 48 After the third year of the program, the board
2 49 shall annually adjust the levels of surcharges on
2 50 electric accounts under paragraph "a" based on the
3 1 total program budget developed by the division. When
3 2 determining the per account charge, the board shall
3 3 not substantially deviate from the cost allocation
3 4 among consumer groups reflected in the initial funding
3 5 charges. Any increase in monthly surcharges as
3 6 provided in this subparagraph shall not go into effect
3 7 without prior approval by joint resolution as adopted
3 8 by the general assembly.
3 9 For purposes of this paragraph, "division" means
3 10 the division of community action agencies within the
3 11 department of human rights or its successor.
3 12 (2) Two million dollars in a separate account to
3 13 be used for environmental assessment as provided under
3 14 subsection 3. Eighty-five percent of the amounts
3 15 allocated to this account are appropriated to the Iowa
3 16 energy center created in section 266.39C. Fifteen
3 17 percent of the amounts allocated to this account are
3 18 appropriated to the center for global and regional
3 19 environmental research established by the state board
3 20 of regents. Notwithstanding section 8.33, the
3 21 unencumbered or unobligated moneys remaining in the
3 22 account at the end of any fiscal year shall not revert
3 23 and shall be retained by the centers for the purposes
3 24 designated. Notwithstanding section 12C.7, subsection
3 25 2, interest or earnings on investments or time
3 26 deposits of the moneys in the account shall be
3 27 retained and used for the purposes designated under
3 28 subsection 3.
3 29 The Iowa energy center and the center for global
3 30 and regional environmental research shall each provide
3 31 a report to the legislative fiscal committee on a
3 32 monthly basis regarding any expenditures of funds
3 33 associated with each center's activities under this
3 34 subparagraph. A monthly report shall cover a calendar
3 35 month and is due the tenth day of the following month.
3 36 (3) Fifty-three million five hundred thousand
3 37 dollars in the environmental fund created in
3 38 subsection 4. The treasurer of state shall make
3 39 disbursements from this fund as requested by the
3 40 department of natural resources. The unencumbered or
3 41 unobligated moneys remaining in the fund at the end of
3 42 any fiscal year shall not revert but shall be
3 43 available for expenditure during subsequent fiscal
3 44 years. Notwithstanding section 12C.7, subsection 2,
3 45 interest or earnings on investments or time deposits
3 46 of the moneys deposited in the environmental fund
3 47 shall be credited to the fund.
3 48 d. Amounts collected pursuant to this subsection
3 49 and remitted to the treasurer of state are
3 50 appropriated for the purposes provided in this
4 1 subsection and shall not be subject to appropriation
4 2 for any other purpose by the general assembly, but
4 3 shall be used only for the purposes set forth in this
4 4 section.""
